77 Holland that he be before our Justices of our Co.ty Court of Somrsett to be held at Dividing Creek the third tuesday of August Next to Shew if anything for himselfe he hath or to Say Knoweth Wherefore the afd Benj.a Wailes his Execution against him of the Judgm.t afd to have Ought not if to him it Seemeth Expedient & have you then there the Names of them by whom you Make the same Known to him & this Writt Wittness Saml Hopkins Gent Chief Justice of our Said Court this twentieth day of June in the twelfth Year of our Dominion &a On the Backside of the foregoeing writt was thus Endorsed made known P Francis Allen Sherr And the afd Richard Holland adm.r as afd by George Dashiell his attry Comes & defends the force & Injury when &.c and Prays Leave to Imparle hereunto untill the Next Court & he hath it and the Same Day is given to the afd Benj.a Wailes here also &.a Att which said Next Court to witt the twenty first day of November Ann.o Dom one thousand Seven hundred & twenty Seven Came again as well the afd Benj.a Wailes as the afd Richard Holland by their attrys afd and the afd Richard Holland by his said attry thereupon prayed further ^Leave^ to Imparle hereunto untill ye Next Court he hath it & the same Day is given to the afd Benj.a Wailes here also &a Att which said Next Court to witt the twenty Nineteenth day of March Anno Dom one thousand seven hundred & twenty Seven Came again as well the afd Benj.a Wailes as the afd Richard Holland by their attrys afd and thereupon the said Benja Wailes by his said attorney Prays that the afd Richard Holland to his writt of Scirefacias afd may answer &.c but the said Richard altho' Solemnly Called Comes not but makes default &.c Therefore it is Considered by the Court here the Same day and Year Last Mentioned that the afd Benj.a Wailes have his Execution against the afd Richard Holland adm.r of the afd Samuel Shewell ^of^ fourteen hundred and fifty three pounds of tob.o his damages afd as also Two hundred 225 and Twenty five pounds of tobacco for his damages ^which he^ Sustained by Occasion of delay of Execution of the Judgmt afd according to the form of the Statute in Such Cases Lately made and provided to be Levied of the goods and Chattells which were of the afd Sam.l at the time of his death and which to the hands of the afd richard hereafter Should happen to Come to be administred &c
twenty two pounds of tob.o as by Acco.t herewithin Court Produced May appear and so thereof being Indebted the said Thomas in Consideration thereof afterwards to witt the same day and Year afd at the County afd and within the afd Jurisdiction upon himselfe assumed and to the same Allex.d then and there faithfully promised that he when afterwards he should be thereto requested he the afd Sum of Eight hundred and twenty two pounds of tob.o to the same Allexander would well and faithfully Content and Pay Nevertheless (ye ) |
