1727 76 Thereupon prayed further Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd Allexander Wordie here also &c Att which said next Court to witt the Ninteenth day of March Anno Dom one thousand Seven hundred and twenty Seven Came again as well the afd Allexd Wordie as the afd Philip russell by their Attorneys afd and the afd Philip Russell by his said attorney prays the Justices that they may dissolve themselves into a Court of Chancery and that the action afd in the plea afd may be determined according to an act of assembly in Such Cases made and provided which is Granted &.c Whereupon all and Singular the premisses by the Court being heard and fully understood and Mature deliberation thereupon had &c Wherefore it is Considered by the Court here the Same day and Year Last mentioned that the afd Alexander Wordie Recover against the afd Philip Russell Executor of the Same Samuel Davis four pounds Nine Shillings Curr.t mony his damages by occasion of the premisses afd as allso 245 Two hundred and forty five pounds of tob.o for his Costs and Charges by him about his Suit in that Part Expended to the Same Alexander by the Court here of his assent adjudged of the goods and Chattells which were of the afd Samuel Davis at the time of his death in the hands of the same Philip Remaining to be administred if so much ^thereof^ in his hands he hath and if so much ^thereof^ in his hands he hath not than the Costs afd to be Levied of the proper goods and Chattells of the Same Phillip and the afd Deft in mercy &c
of Somrsett (to witt on the twentieth day of August Ann.o Dom one thousand Seven hundred & twenty three before Charles Ballard Gent & his associates then our Justices at Dividing Creek & by Consideration of the Same Court Recovered against Richard Holland of alhallows parish in Somrsett Co.ty Planter adm.r of all & singular the goods & Chattles rights & Creditts of Charles Shewell late of the Co.ty afd dec.d fourteen hundred & fifty pd.s of Tob.o for his Dam.s which he Sustained as well by occasion of the Nonperformance of a Certain promise & assumption by the afd Charles Shewell in his Life to the Same Benj.a lately made as for his Costs & Charges by him about his suite in that part Expended to be Levied of the Goods & Chattles which were of the afd Charles Shewell at the time of his Death & which to the hands of the afd Richard Holland adm.r as afd Should after Come to be administred if so Much thereof in his hands he Should have whereof he is Convict as by the record & Proceedings thereof in our Same Court before our Same Justices at Dividing Creek remaining Manifestly appeareth Notwithstanding Execution of the Judgm.t afd as yett remaineth to be made as by the Insinuation of the afd Benj.a we have received & because we are Willing that which in our Same Court is rightfully Acted Ought to be duely Executed we Command you that by good honest & Lawfull Men of your Balywick you Make Known unto the Said Richard (Holland) |
