                              Philip Russell Executor of the last will and
testament of Samuel Davis late of Somerset County decd was attached
to answer unto Alexander Wordie of a plea of trespass upon the Case &c
          And whereupon the same Allex.d Wordie by Levin Gale his attorney Complains that whereas
       the afd Samuel in his Life time the tenth day of May one thousand Seven hundred & twenty
       five at Somersett County afd within the Jurisdiction of this Court was Indebted to ye same Allex.d
       in the Sum of four pounds Nine Shillings currant Mony and so thereof being Indebted ye said
       Samuel in his Life time afterwards to Witt the same day and year afd at the County afd within ye
       afd Jurisdiction in Consideration upon himselfe assumed and to the same Allex.d then & there faithfully
       promised that he when afterwards he should thereto be requir'd he the afd Sum of four pounds
       Nine Shill.s Currt Mony to the Same Allexander would well and faithfully Content & pay Nevertheless
       the said Samuel in his Life time and the afd Philip since the death of the said Sam.l
       the promise and assumption afd of the afd Samuel in his Life time so as afd Made Little
       regarding and Plotting and fraudulently Intending the Same Allexd in this part to defraud
       and deceive Neither the afd Samuel in his Life time nor the afd Philip russell since
       the death of the said Samuel to he whome Execution of the Last will and testam.t of the
       same Samuel was in due form of Law Committed the afd Sum of four pounds Nine shillings
       Currt Mony hath paid or the said Allex.d for it in any wise Satisfyed altho' the said Sam.l
       in his Life time afterwards (vizt) the tenth day of June Anno Dom one thousand seven
       hundred and twenty Six and the afd Philip since the death of the said Samuel the
       tenth day of august Anno Dom one thousand Seven hundred and twenty Six at Somrsett
       County afd within the afd Jurisdiction by the same Allex.d were thereto requested but they
       and every of them the same hitherto to pay or the same Allex.d for it in any wise ^to^ Contented
       Have altogether refused and the said Philip the same to do Still doth Refuse
       Whereby the same Allex.d says he is worse and hath Damage to the value of Nine
       pounds Currt Mony and thereof he Brings this Suite &.c
                                                                          L Gale P Quer Pledges &c   Jno Doe Richd roe

       And the afd Philip Russel Ex.r as afd by George Dashiell his attorney Comes and defends
       the force and Injury when &.c  And prays Leave to Imparle hereunto untill the Next Court
       and he hath it and the same day is given to the afd Allexander Wordie here also &c

          Att which said Next Court to witt the fifteenth day of August Anno Dom one thousand seven
       hundred and twenty seven Came again as well the af Allex.d ^Wordie^ as the afd Philip ^russell^ by their attorneys
       afd and the afd Philip russell by his said attorney thereupon prayed further Leave to
       Imparle hereunto untill the Next Court and he hath it and the same day is given to ye afd
       Plft here also &.c
                                       Att which said Next Court to witt the twenty first day of Novem.r
       Anno Dom one thousand seven hundred and twenty seven Came again as well the afd Allex.d Wordie
       as the afd Philip russell by their attorneys afd and the afd Philip Russell by his said attorney
