75 And the afd Robert Collier administrator as afd by George Dashiell his attorney Cometh and defendeth the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it and ye Same day is given to the afd Jno Donelson here also &c Att which said next Court to witt the twentyeth day of June Anno Dom One thousand Seven hundred & twenty Seven Came againe as well the afd Jno Donelson as the afd Robert Collier by their attorneys afd and the afd Robert Collier by his said attorney thereupon prayed further Leave to Imparle hereunto untill the next Court and he hath it and the Same day is given to the afd Jno here also Att which said Next Court to witt the fifteenth day of August ann.o Dom one thousand seven hundred & twenty seven Came again as well the afd Jn.o Donelson as the afd Robt Collier by their attrys afd & the afd Rob.t Collier by his said attry thereupon prayed further Leave to Imparle hereunto untill the Next Court & he hath it & the same day is given to the afd Jn.o here also Att which said Next Court to witt the twenty first day of November ann.o Dom one thousand seven hundred & twenty seven Came again as well the afd John Donelson as ye afd Rob.t Collier by their attrys afd & the afd Rob.t Collier by his said attry thereupon prayed Further Leave To Imparle hereunto untill the Next Court & he hath it & the Same Day is given to the afd John here also Att which said Next Court to witt the Nineteenth day of March ann.o Dom one thousand Seven hundred & twenty Seven Came again as well the afd Jn.o Donelson as the afd Rob.t Collier by their attrys afd & the afd Robt Collier by his said attry as before defend the force & Injury When &a And saith that he is not Indebted in Manner & forme as the Plft against him hath Complained & of this he puts himselfe upon the Country And the afd Plft Likewise Thereupon Command was given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &.c by whom &.c and who neither &.c to Recognize &.c because as well &.c of which said Preceipt the said Sherr to witt Francis Allen Gent.n Now hereat this day to witt the same day and year last mentioned Comes and makes return that he hath here ready twelve &.c as by his said Preceipt he was Commanded And now hereafterwards to witt the Same day and Year Came as well the afd Jno Donelson as the afd Robert Collier by their attorneys afd and the Jurors of that Jury therein Impannelled being Called ^likewise^ Came to witt W.m Turpin, Edward Beachamp, Thomas Dixon, Thomas Billins, Thomas Robins, Fisher Waltom, Parker Selby, Fisher Jno Fleming, William Handy, Robert Mitchell, Jn.o Pope and Thomas Peale who being duely Elected tryed and Sworn to Say the truth in the Premisses and after the same Jurors were by the Court Charged Concerning their Verdict and from the bar here to Commune together amongst themselves of and Concerning their giving in of their said Verdict in the premisses afd did recede and amongst themselves being fully agreed Came againe to the Barr to give in that Verdict But the afd Jno Donelson altho' Solemnly Called Cometh not Nor his his writt afd further Prosecuted against the afd Robert Collier &c Therefore it is Considered here the Ninteenth day of March Anno Dom One thousand seven Seven hundred and twenty Seven that the afd Jno Donelson take nothing by his writt and declaration afd but that he and his pledges of Prosecuting that is Jno Doe and Richard Roe be in Mercy &c and that the afd Robert Collier adm.r as afd Goe thereof without day and further it is Considered that the afd Robert Collier Recover against the 449 afd Jno Donelson pounds of tobacco for his Costs and Charges by him about his suit in that part sustained to the same Robert Collier by the Court here adjudged according to the form of the statute in such Case Late made and provided and that ye afd Robert Collier have thereof his Execution &c |
