       March Court            1727                     75

Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh Return
thereof to the Court her Endorsed in these words vizt Non Est declaration Left P Fran Allen sher

          Whereupon the afd Adam Muir by his attorney afd Prays that forasmuch as he has Complyed
with the Law in order to an attachmt he may have Judgmt against the afd Joshua Adge
for his damages afd by way of attachm.t according to act of assembly &c
                                                                                                       Whereupon for that it seems
to the Court here that the said Adam Muir hath Complyed with the law as alledged

                               Therefore it is Considered by the Court here the Ninteenth day of March ann.o
Dom One thousand Seven hundred and twenty Seven that the afd Adam Muir Recover against the
afd Joshua Adge the sum of four pounds Eight Shillings his damages by Occasion of the Premisses
afd as also all Costs and Charges by the said Plft Laid out and Expended about his Suite by way of
attachm.t against the goods Chattells Rights and Creditts of the said Joshua Adge according to act of
239   assembly in Such Case made and Provided &.c

Nicholson Jun.r late of Somersett County afd Marriner decd was Sumoned
to answer unto John Donelson of a plea that he render unto him one
       pound fifteen Shillings Curr.t mony and Eleven hundred and Ninty Nine pounds of tobacco
       which from him he Unjustly detains &c

                         And whereupon the same John Donelson by Levin Gale his attorney saith
       that Whereas the Same John at March Somrsett County Court Anno Dom one
       thousand Seven hundred & twenty four in the Court of the Lord proprietor for the
       County afd held at the court house of the Said County the sixteenth day of march ann.o
       Dom one thousand seven hundred & twenty four by the Consideration of the said Court
       recovered against the afd Roger Nicholson in his Lifetime the afd Sum of one pound
       fifteen Shill.s Curr.t Mony & Eleven hundred & Ninety Nine pd.s of Tob.o for his dam.s
       which he sustained as well by occasion of a Certain Trespass upon the Case as for
       his Costs & Charges by him about his Suit in that part Laid Out & Expended whereof
       the said Roger was Convict as by the record & Process thereof in the Same Court here
       that is to say at Somrsett Co.ty afd fully appears which said Judgm.t still remains in
       full force power & Strength Strength unreversed & unsatisfied by which action
       hath accrewed to the Same John to have & require of & from the Said Rob.t Collier
       to whome adm.rn of all & singular ye Goods & Chattles rights & Creditts of the said roger
       was since his death in due form of Law Committed the Said Sum of one p.d fifteen
       Shills Curr.t Mony & Eleven hundred & Ninety Nine pd.s of Tob.o Nevertheless ye Said Robert
       though often thereto required the s.d sum of one pound fifteen Shills & Eleven hundred &
       Ninety Nine pd.s of Tob.o to the same John hath not rendered but ye s.d Rob.t ye same
       hitherto to doe hath altogether denyed & still doth deny & unjustly detain to ye Dams
       of the same John three pd.s Curr.t mony & two thousand three hundred & Ninety
       Eight pd.s of tob.o & thereof he Brings this Suite &a
