March Court                      1727                     74

before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the
third tuesday of March then next to answer unto John Parker of a plea of trespass upon ye
Case &c  And that thereof he should not fail &c

      Att which said third tuesday of March to witt the Ninteenth day of the same Month Anno Dom
one thousand Seven hundred and twenty Seven being the day of the return of the said writt Cometh
the afd John Parker in his own proper person and the sherr of Somersett County to whome the
foregoeing writt was Directed Likewise Cometh and Maketh and Maketh return thereof
to the Court here Endorsed in these words following vizt    Cepi Corpus P Fran: Allen Sherr

       And the afd Samuel Turner by Levin Gale his attorney Cometh and defendeth the force
and Injury when &c  and the afd Jn.o Parker then and there his writt afd against the afd Saml
Turner did not Prosecute with Effect but voluntarily Suffered his Suit to be discontinued &.c

          Therefore afterwards to witt the Ninteenth day of March Anno Dom One thousand Seven
hundred and twenty seven by the discretion of the Justices here were adjudged the same
143   Samuel Turner the sum of One hundred and forty three                     pounds of tobo
for his Costs and Charges by him about his defence in that part sustained according to the
form of the Statute in such case thereof Lately made and Provided and the afd Jno Parker
in Mercy and that the afd Sam.l Turner have thereof his Execution &c

Command was given to the Sherr of somersett County that
he should take James Breeman Late of somersett County Merch.t
if he should be found in his Balywick & him Should safe Keep
so that he Might have his body before the Justices of his Lordships
             County Court of Somrsett to be held at Dividing Creek the third tuesday
       of March then Next to answer unto John Park Eliz.a Rigen of a plea of trespass
       upon the Case &a   And that thereof he Should not fail &a

             Att which said third tuesday of March to witt the Nineteenth day of the
       Same Month Anno Dom one thousand Seven hundred & twenty seven being ye day
       of the return of the said Writt Cometh the afd Eliz.a Rigen by George Dashiell
       her attry & the Sher of Somrsett Co.ty to whome the foregoing Writt was directed
       Likewise Cometh & Maketh return thereof to the Court here Endorsed in these
       words following vizt  Cepi Corpus P me   Francis Allen Sher

                And the afd James Breman by Levin Gale his attry Cometh & Defendeth the
       force & Injury when &a   And the afd Eliz.a Rigen then & there her Writt afd
       against the afd James Breeman did not Prosecute with Effect but voluntarily
       Suffered her suite to be Discontinued &a

                Therefore afterwards to witt the Nineteenth day of March anno Dom
       one thousand Seven hundred & twenty Seven by the discretion of the Justices here
143   were adjudged the Same James Breman the Sum of
                         pounds of tob.o for his Costs & Charges by him about his defence in that
