Memorand.m ^the^ Plft in his Own proper person sued out his Lordships writt of attachment
against the deft the tenor whereof followeth in these words viz.t
        Somersett fs  Charles absolute Lord and proprietary of the provinces of Maryland
and avalon Lord Baron of Baltemore &c   To the Coroner of Somrsett County Greeting we Command
you that you attach any the Goods Chattles rights or Creditts of Ebenezer Cooke
Late of Somrsett County Gent if they Shall be found in your Balywick to the Value of
Six hundred pounds of Tob.o & when you have the Same so attached or any part
thereof the Same in your Custody safe Keep so yt you have them before the Justices
of our Coty Court of Somrsett to be held at Dividing Creek ye third tuesday of March
Next then & there to be Condemned according to act of assembly to & for the use of
a Certain Jn.o Brown unless the said Ebenezer Cook by himselfe or his attry Shall
appear & answer unto ye said John Brown in a plea of trespass upon the Case &a
According to Law & that by good & Lafwull Men of your Balywick you make Known
unto the person or persons in whose hands you Make the Same attachment that
he She or they be & appear before the Justices of our Coty Court to be held as afd to
Shew Cause if any he she or they have why the same goods Chattles rights or Creditts
so attached in his her or their hands ought not to be Condemned & Execution thereof
had & made according to the form of the act of assembly in such Case made & provided
if to him her or them it shall seem Mete & how you shall Execute this Writt yt you
Make Known unto our Said Justices at the day & place afd & have you then and
there this Writt Wittness Saml Hopkins Gent Chief Justice of our Said Court the
twenty fifth day of November in the twelfth year of our Dominion &c

             Att which said third tuesday of March to witt the ninteenth day of the same month Anno Dom
One thousand Seven hundred and twenty Seven being the day of the Return of the said writt Cometh ye
said John Brown in his proper person and the Coroner of Somersett County to whom the foregoeing writt
was directed and makes return thereof to the Court here Endorsed in these words vizt
                                                    Attached in the hands of Francis Allen sher full Value
                                                                                              P me Jno Purnall Coroner

                   Whereupon the afd John Brown in his Own proper person prays that the afd Sum of
Six hundred pounds of tobacco attached in the hands of the afd Fran: Allen as of the rights and Credits
of the afd Ebenezer Cook may be Condemned in the hands of the said Francis Allen towards Satisfying
unto ^him^ the afd Jno Brown the sum of Six hundred pounds of tobacco afd as all Costs accrewing upon the
writt of attachm.t afd    And whereupon the afd Francis Allen Altho; Solemnly Called Cometh not but
makes default nor Shews Cause why &c
                                                                               Therefore it is Considered by the Court here the
Ninteenth day of March anno Dom One thousand seven hundred and twenty Seven that the afd Sum
of Six hundred pounds of tobacco so as afd attached be Condamned in the hands of the afd Francis Allen
as of the Rights and Creditts of the afd Ebenezer Cooke towards Satisfying unto the said Jno Brown the
sum of Six hundred pounds of tobacco afd as all Costs accrewing upon the writt of attachmt afd and that
the said Jno Browne have thereof his Execution ag.t the said Fran Allen according to act of assembly &c

Turner Jun.r Late of Somersett County Planter if he ^should^ shall be found in his
Bailywick and him should safe Keep so that he might have his Body
