of the provinces of maryland and avalon Lord Baron of Baltemore &c To the Coroner of somersett County Greeting we Command you that you attach any the goods Chattells rights or Creditts of Ebenez.r Cook Late of Somersett County Gent if they shall be found in your Bailywick to the value of four hundred and fifty pounds of tob.o and when you have the same so attached or any part thereof ye same in your Custody safe keep so that you have them before the Justices of Our County Court of Somersett to be held at Dividing Creek the third tuesday of march Next then and there to be Condemned according to Act of assembly to and for the use of a Certain Joseph Pemberton unless ye s.d Ebenezer Cook by himselfe or his attorney shall appear and answer unto the said Joseph Pemberton in a plea of trespass upon the Case &.c According to Law and that by good and Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the same attachm.t that he she or they be and appear before the Justices of Our County Court to be held as afd to shew Cause if any he she or they have why the same goods Chattells Rights or Creditts so as attached in his her or their hands ought not to be Condemned & Execution thereof had and made according to the form of the act of assembly in such Case made & provided if to him her or them it shall seem Mete and how you shall Execute this Writt that you make Known unto our said Justices at the day and place afd and have you then & there this Writt Wittness Saml Hopkins Gent Chiefe Justice of our said Court the twenty fifth day of Novem in the twelfth year of our Dominion &c Att which said third tuesday of March to witt the ninteenth day of the same month Ann.o Dom One thousand seven hundred and twenty Seven being the day of the Return of the said writt Cometh the said Joseph Pemberton in his proper person and the Coroner of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed viz.t Attached full value in the hands of Fran Allen sherr P Jn.o Purnall Coroner Whereupon the afd Joseph Pemberton Prays that the afd Sum afd attached in the hands of the afd Francis Allen as of the Rights and creditts of the said Ebenezer Cook may be Condemned in the hands of the said Francis Allen towards Satisfying unto the afd Jos: Pemberton the Sum of four hundred and fifty Pounds of Tob.o afd as all Costs accrewing upon the writt of attachm.t afd &c whereupon the said fran Allen altho' Solemnly Called Comes not but Makes default &.c Therefore it is Considered by the Court here the Ninteenth day of March One thousand Seven hundred and twenty Seven that the afd Sum of four hundred and fifty pounds of tobacco so as afd attached in the hands of the afd Fran Allen as of the Rights and Creditts of the afd Ebenezer Cook may be Condemned in the hands of the said Fran Allen Towards Satisfying unto the afd Jos: Pemberton the Sum of four hundred and fifty pounds of tobacco afd as all Costs upon the writt of attachmt afd and that the said Jos: Pemberton have thereof his Execution against the afd fran: Allen according to act of assembly in Such Case made and provided &c |
