1727 72 twenty Second day of June Ann.o Dom one thousand Seven hundred & twenty before Charles Ballard Gentleman and his associates then Justices of our Said Court at Dividing Creek by Consideration of the Same Court Recovered against Thomas Baker of Coventry Parish ^in^ at the County of Somrsett planter al.s Dict.s Thomas Baker of Somrsett County in Maryland Sawer as well a Certain Debt of Eighteen hundred & Eight & a halfe Cutts of Cypruss Timber Each quarter five Foot four Inches Long as three hundred and Eight pounds of Tob.o Costs Laid out & Expended Whereof he is Convict as by the record and Proceeding thereof in our Same Court before our Justices at Dividing Creek residing Manifestly appeareth Nevertheless Execution of the Judgm.t afd as yett remaineth to be made as by the Insinuation of the afd Thomas Billin & Catherine his Wife we have received and Because we will that those things which in our Same Court are rightfully done ought to be duely Executed we Command you that by good & Lawfull men of your Balywick you Make Known unto the afd Tho.s Baker that he be before our Justices of our Co.ty Court of Somrsett to be held at Dividing Creek the third tuesday of March Next to Shew Cause if anything for himselfe he hath or to say Knoweth Wherefore the afd Tho.s Billin and Catherine his wife their Execution against him of the Judgment afd to have Ought not according to the form of the Recovery afd if to him it Seemeth Expedient & have you then & there the Names of them by whom to him you Make Known & this Writt Wittness Saml Hopkins Gent Chiefe Justice of our Said Court the twenty fifth day of November in the twelfth year of our Dominion &.c Att which said third tuesday of March to witt the ninteenth day of the same month Ann.o Dom One thousand seven hundred and twenty Seven being the day of the Return of the said Writt Cometh the afd Thomas Billin and Catherine his wife by their attorney afd and the Sherr of somersett County to witt Fran: Allen Gent at the Same day Returned that he by virtue of the writt afd to him directed he had made known unto the afd Thomas Baker by Jn.o Doe and Richard Roe good and Lawfull men of his bailywick that he be before his Lordships Justices of the peace for the County afd at the day and place afd to Shew in form afd &.c And whereupon the afd Thomas Baker so before warned and at the same day being Solemnly Called Cometh not but maketh default &c Therefore it is Considered by the court here the Ninteenth day of March Anno Dom One thousand seven hundred and twenty Seven that the afd Thomas Billin and Catherine his wife Exrx as afd have their Execution against the afd Thomas Baker of Eighteen hundred and Eight and a halfe Cutts of Cypruss Timber Each quarter five foot four Inches Long and three hundred and Eight pounds of tobacco Debt and Costs afd according to the force form and Effect of 311 the Recovery afd as also three hundred and Eleven pounds of tobacco for their damages which they had by Occasion of Delay of Execution of the Judgmt afd according to the form of the Statute thereof Lately made and provided &c |
