       A Copy of the foregoeing declaration and acc.o were made & sent to be Served on the deft
with the writt in the plea afd
                                                       Att which said third tuesday of march to witt the Ninteenth
day of the same Month Anno Dom one thousand seven hundred and twenty Seven being the day
of the return of the said writt Come the afd Benj.a Wailes by his attorney afd and the Sherr of
Somersett County to whome the foregoeing writt was directed Likewise Cometh & maketh return thereof
to the Court here Endorsed in these words viz.t
                                                       Cepi Corpus decl.n delivered in time P Fran: Allen Sherr

And whereupon the afd Archibald Greer in his own proper person Comes and defends
the force and Injury when &.c and saith that he Cannot gain say the action afd nor Can he
say but that the afd Benj.a Wailes ^ought^ not to recover his damages by occasion of the Nonperformance
of a Certain promise and assumption afd to five hundred and twenty Seven pounds
of tob.o and the same declaration in all the words before Expresly Confesseth

          Therefore it is Considered by the Court her the Ninteenth day of March Ann.o
Dom one thousand seven hundred and twenty Seven that the afd Benj.a Wailes Recover ag.t
the said Archibald Greer the Sum of five hundred and twenty Seven pounds of tob.o his
Damages afd in form afd Confessed as also Two hundred and forty Nine
249                    pounds of tob.o for his Costs and Charges by him about his suite in that part
Expended to the same Benj.a Wailes by the Court here of his assent adjudged & the afd deft in
Mercy &c

 Memorand.m the Plft by Levin Gale his attorney sued out his Lordships
writt of Scirefacias against the deft the tenor whereof followeth in
these words viz.t

Proprietary of the provinces of Maryland and Avalon Lord Baron
           of Baltemore &.c   To the Sherr of Somersett County Greeting whereas Thomas Billin and
          Catherine his wife Executrix of the Last will & testement of Will.m White Late of
          the County afd Marriner dec.d Lately in our County Court of Somrsett here to witt the
