             March Court            1727            71

foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these ^words^
following vizt         Non Est Inventus P Fran Allen sher

                Whereupon the afd John Housman by his attorney afd prays that forasmuch as he hath Complyed
with the Law in Order to an attachm.t he may have Judgm.t against the said William Twyford for his damages
afd by way of attachment according to act of assembly &c
                                                                                           Whereupon for that is Seems to the Court
here that the afd John Housman has Complyed with the Law as alledged;

                            Therefore it is Considered by the Court here the Ninteenth day of March Anno Dom One
thousand seven hundred and twenty Seven that the afd John Housman Recover against the afd Wm
Twyford five pounds Seventeen Shillings and three pence halfe penny Curr.t mony his damages by
242   occasion of the premisses afd as all Costs and Charges by the said plft Laid Out and Expended by way of
attachment against the goods Chattells Rights and Creditts of the said William Twyford According to act of
assembly in such Case made and provided &c

Archibald Greer
 Command was given to the Sherr of somersett County that he Should
take Archbald Green Late of Somersett County Planter if he should be found in his
Bailywick and him should safe Keep so that ^he might have^ you have his Body before the Justices of his
Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of March then next to
answer unto Benj.a Wailes of a plea of trespass upon the Case &c   and that thereof he should not fail &c

       And the afd Benj.a Wailes by Levin Gale his attorney proceeded against the afd Archibald
Greer in the plea afd as followeth viz.t
                                                                         Somersett fs:   Archbald Greer Late of Somersett
County Planter was attached to answer unto Benj.a Wailes of a plea of trespass upon the Case &c

       And whereupon the same Benj.a by Levin Gale his attorney Complaines that whereas the afd
Archibald the tenth day of august Anno Dom one thousand Seven hundred and twenty seven at somersett
County within the Jur of this Court was Indebted to the same Benj.a in the sum of five hundred
and twenty seven pounds of tob.o as by Acc.t herewithin Court produced may appear and so thereof being ^Indebted^
the said Archibald in Consideration thereof afterwards to witt the same day and year afd at the
County afd and within ye afd Jurisdiction upon himselfe assumed and to the same Benj.a then & there
faithfully promised that he when afterwards he should be thereto requested he ye afd Sum of five
hundred and twenty seven pounds of tob.o to the same Benj.a would well and faithfully Content
and pay Nevertheless the said Archibald his promise and assumption afd in form afd made
not regarding but ^plotting &^ fraudulently Intending him the same Benj.a in that part Craftilly & subtilly
to defraud and Deceive the afd Archibald ye afd Sum of five hundred and twenty Seven pd.s
of tob.o or any part thereof to the same Benj.a he hath not paid or him for it in any wise
Contented altho' the same to do the afd Archibald afterwards viz.t the same day &
Year afd at the County afd and within the afd Jurisdiction by the same Benj.a
was requested but he the same hitherto to Doe hath Altogether refused & still
