Francis Allen Sherr lately in our County Court of Somersett to witt the twenty first day of June Anno Dom one thousand seven hundred and twenty six before Saml Hopkins Gent and his associates then Justices of of our said County Court of Somersett at Dividing Creek by ye Consideration of ye same Court recovered against Thomas Goddard late of Somersett County tayler as well a Certain Debt of Eight thousand pounds of tobacco as six hundred and Eighteen pounds of tobacco which to the same Francis in our said Court were adjudged for his Costs and Damages which he had by occasion of the detaining of the same Debt whereof he is Convict as by the record and prosess thereof in our same Court before our Justices at Dividing Creek remaining Manifestly appeareth not withstanding Execution of the Judgmt afd as yet remaineth to be done as by the Insinuation of the afd Francis Allen we have received and because we are willing that these things which in our same Court are rightfully Acted ought to be duly Executed we Command you that by honest and Lawfull men of your Bailywick you make Known to the afd Thos Goddard that he be before our Justices of our County Court of Somersett to be held at Dividing Creek the third tuesday of march next to shew Cause if any thing for himselfe he hath or to say Knoweth whereof the afd Francis Allen execution against him of ye Debt and Damages afd to have ought not according to the recovery afd if to him it seemeth Expedient and have you then and there the Names of them by whom to him you make Known and this Writt Wittness Saml Hopkins Gent Chiefe Justice of our said Court ye 25.th day of novem in ye 12.th year of Our Dominion &c Att which said third tuesday of March to witt the Ninteenth day of the Same month Anno Dom One thousand Seven hundred and twenty Seven being the day of the Return of the said Writt Cometh the said Francis Allen by his attorney afd and the Coroner of Somersett County to witt Henry Ballard Gent.m at the same day Returned that he by vertue of the writt afd to him directed he had made known to the afd Thomas Goddard that he be before the Justices of his Lordships County Court of Somersett at the time and place afd by Richard Stevens and Peter Persons honest and Lawfull men of his bailywick to shew &c And the afd Thomas Goddard altho' so before warned and at the same day being Solemnly Called Cometh not but makes default &c Therefore it is Considered by the Court here the Ninteenth day of March Anno Dom One thousand Seven hundred and twenty Seven that the afd Francis Allen have his Execution against the afd Thomas Goddard of Eight thousand pounds of tobacco his debt afd as Six hundred and Eighteen pounds of tobo his Damages in the Judgmt ^afd^ specified as also three hundred and thirty three pounds of tobacco for his damages sustained by Occasion of Delay of Execution of the Judgm.t afd according to the form of the Statute in such Cases Lately made and provided &c
