March Court           1727                     69

In our same Court before Our Justices at Dividing Creek wer adjudged for his Damages which
he had by occasion of a Certain promise and assumption to the same Joseph by the afd Samuell
Lately Made and not performed whereof he is Convict as by the records and proceeding thereof
in our same Court before our Justices Remaining Manifestly appeareth Nevertheless
Execution of the Judgment afd as yet remaineth to be made as by the Insinuation of the said
Joseph MccClester We have received and because we are willing that those things which in our
same Court are rightfully Acted ought to be duly Executed we Command you that by Good
and Lawfull men of your Bailywick you make Known unto the afd Samuell Wheler that he
be before our Justices of Our County Court of Somersett to be held at Dividing Creek the
third tuesday of November next to shew Caus if any for himselfe he hath or to say Knoweth
wherefore ye afd Joseph MccClester his Execution against him of the damages afd to
have ought not According to the form of the recovery afd if to him it shall Seem Expedient
And have you then and there the Names of them by whom you make the same Known and
this Writt Wittness Saml Hopkins Gent Chiefe Justice of our said Court the 18th day of aug.t
in the 12.th Year of Our Dominion &c

          Att which said third tuesday of Novem to witt the twenty first day of the same month
Ann.o Dom One thousand Seven hundred and twenty Seven being the day of the return of
the said Writt Cometh the afd Joseph MccClester by his attorney afd and the Sherr of Somersett
County at the same day Returned that the afd Sam.l Wheler hath nothing &c nor is not found &c

              Therefore Command is againe given to the Sherr of Somersett County that by good
and Lawfull men of his Bailywick he Should make known unto the said Samuel Wheler
that he be before the Justices of his Lordships County Court of Somersett to be held at dividing
the third tuesday of March then Next to Shew in form afd if &.c and further &.c and the same
is Given to the afd Plft here also &.c

                Att which said third tuesday March to witt the Ninteenth day of the same month
ann.o Dom One thousand Seven hundred and twenty Seven that the afd Joseph MccClester have his Execution
against the afd Samuel Wheler of Seven hundred and Seventy Nine pounds of tobacco his damages
225   afd according to the force form and Effect of the recovery afd as also Two hundred and Twenty
five                              pounds of tobacco for his Costs and Damages sustained by Occasion of delay
of Execution of the Judgmt afd according to the form of the Statute in Such Case Lately made and
provided &c
