Novem Court
1727 60 in manner and form as the afd James and Mary above against him have declared nor but that they Ought to recover their damages by occasion of the Nonperformance of the promise afd to six hundred and thirty Nine pounds of tobo and the same declaration in all the words before expressly Confesseth &c Therefore it is considered by the court here the twenty first day of Novem Anno Dom One thousand seven hundred and twenty seven that the afd James ^Martin^ and Mary his ^wife^ Exrx of the same Robert Recover against the afd Tobias Pepper Six hundred and thirty nine pounds of tob.o their damages afd in form afd Confessed as also Two hundred 207 and seven pounds of tob.o for their Costs and damages Charges by them about their suit in that part expended by the Court here of their assent adj to the same James and Mary adjudged and the afd deft in Mercy &c Ordered by the Court that Isaiah Bredall pay unto John Purnall Jun.r the Sum of two hundred and seventy pounds of tobacco being due unto him for his attendance Nine days as evidence on behalfe of the said Isaiah Bredall against Henry Alexander he having made oath to the same &c Ordered by the Court yt Isaiah Bredall pay unto Rich.d Holland the sum of one hundred & Eighty pd.s of tob.o being due unto him for his attendance Six Days as Evidence on Behalfe of the said Isaiah Bredall against Henry Alexander he having made at Oath to the same &a Ordered by ye Court y.t Jn.o Scarbrough pay unto Jn.o MaCalley the sum of one hundred & fifty pd.s of Tob.o being due unto him for his attendance five days as Evidence on Behalfe of ye said Jn.o Scarbrough against Jn.o Bishop he having made Oath to the same &a Ordered by the Court y.t Jno Scarbrough pay unto W.m Davis the Sum of two hundred and ten pd.s of tob.o being due unto him for his attendance Seven Days as Evidence on Behalfe of ye s.d Jno Scarbrough against Jn.o Bishop he having Made Oath to the same &a Ordered by the court that Patience Dighton pay unto John Merrill and Francis Henderson Ninty pounds of tobacco each for their attendance three days each on behalfe of his Lordship Against her they having made Oath to the same &c Ordered by the Court that Patience Dighton pay unto Margrett Merrill, Catherine Layfeild and Sarah Lamberson Sixty pounds of tobacco Each being due unto them for their attendance two days Each as Evidences on behalfe of his Lordship against her &c The Court adjourns till the third tuesday of March Next Anno 1727 |
