Robert in his Lifetime then & there faithfully promised yt he when afterwards he
should be thereto required he ye afd Sum of Six Hundred & thirty Nine pd.s of Tob.o to the
same Rob.t would well & faithfully Content & pay Nevertheless ye S.d Tobias his promise
& assumption afd so as afd Made not regarding but Plotting & fraudulently Intending
the afd Rob.t in his lifetime & ye afd Mary since his death to whome Execution of ye last
will & testam.t of ye same Rob.t (since ye death of ye said rob.t) & whilst ye said Mary was
Sole was in due form of Law Committed & ye afd James & Mary his wife since ye Espousalls
between ye said James & Mary Celebrated in yt part to Defraud & deceive he ye afd
Tobias ye afd Sum of Six hundred & thirty Nine pd.s of Tob.o or any part thereof to ye
same Rob.t in his Lifetime or ye afd Mary since his Death whilst ye said Mary was
Sole or to ye afd James & Mary his wife since ye Espousals between ye s.d James & Mary
Celebrated hath not paid or any of them for it in anywise Contented altho' ye said Tobias
was often thereto required requested viz.t by ye same rob.t in his Lifetime ye tenth day
of Novem.r Anno Dom one thousand seven hundred & twenty four & by ye s.d James and
Mary since ye Death of ye s.d Rob.t & ye Espousals between ye s.d James & Mary Celebrated
viz.t ye tenth day of Jan.ry Anno Dom one thousand Seven hundred & twenty Six
& often afterwards at Somrsett Co.ty afd within ye Jur of this Court but ye same
Tobias ye same hitherto to pay or any of them for it to Content hath altogether
refused & still doth refuse whereby the same James and Mary his wife says
th they are ye worse & hath Dam to ye value of one thousand two Hundred & seventy
Eight pd.s of Tob.o & thereof they Brings this Suite &a     L Gale P Quer pledges &.a J Doe R Roe
