was attached to answer unto William Holland and Elizabeth his
wife Executrix of the last will and testament of Thomas Ennalls late of
    Dorchester County Esq.r and William Ennalls Executor of the said Last Will and testament of a plea
    of trespass upon the Case &c

      And whereupon the same William Holland and Elizabeth his wife and William Ennalls by
Levin Gale their attorney Complaines that Whereas the afd Tobias the tenth day of June one thousand
Seven hundred and Ninetenn at Somersett County afd within the Jurisdiction of this Court
was Indebted to the afd Thomas Ennalls in his Life time in the Sum of Seven hundred and
ten pounds of tob.o for Divers goods wares and Merchandizes before that time at the Especiall
Instance and Request of the said Tobias to ye s.d Tobias by ye afd Thomas Sold & delivered
as by Acc.t herewithin Court produced may appear and so thereof being Indebted the said
Tobias in Consideration thereof afterwards to witt ye same day and Year afd at ye County afd
within the Jurisdiction afd upon himselfe assumed and to the Same Tho.s Ennalls in his
Life time then and there faithfully Promised that he when afterwards he Should be thereto
Required he the afd Sum of Seven hundred and ten pd.s of tob.o to ye same Thos
would well and faithfully Content and Pay  Nevertheless the ^said^ Tobias his Promise and
assumption afd so as afd made not Regarding but plotting and fraudulently Intending
the afd Thomas in his Life time and the afd Elizabeth and W.m Ennalls Since his death
to whom Execution of the Last will and testam.t of the Same Thomas since ye death
of the said Thomas and whilst ye said Eliz.a was Sole was in due form of Law Committed
and the afd William Holland & Eliza his wife ^and^ W.m Ennalls Since the Espousalls between
the said W.m Holland & Eliza Celebrated in that part to defraud and deceive he the afd
Tobias ye afd Sum of Seven hundred and ten pd.s of tob.o or any part thereof to ye same Thos
in his Life Time or the afd Eliz.a or William Ennalls since his death whilst ye said Eliza
was Sole or to the afd William Holland and Eliz.a his wife or ye said W.m Ennalls since ye
Espousals between ye s.d W.m Holland and Eliza Celebrated Hath not paid or any of them for
it in anywise Contented altho' ye s.d Tobias was often thereto Requested viz.t by ye same
Tho.s in his Life time the tenth day of July seventeen hundred and Ninteen & by ye s.d William
Holland and Eliz.a and W.m Ennalls Since the Death of the said Thomas and the Espousals between
the said W.m Holland and Elizabeth Celebrated viz.t the tenth day of June Anno Dom Seventeen
hundred and twenty five and often afterwards at Somersett County afd within ye Jurisdiction
of this Court but the same Tobias ye sane hitherto to pay or any of them for it to be Content
