5 the same day is given to the afd Plft here also Att which said next Court to witt the fifteenth day of Novem anno Dom one thousand seven hundred and twenty six Came againe as well the afd Jn.o McClester as the afd Thomas Ralph and John Collins by their attorneys afd and whereupon the said Thomas Ralph and John Collins by their said attorney pray further Leave to Imparle hereunto until the next Court and they have it and the same day is given to the afd plft here also Att which said next Court to witt the twenty first day of March ann.o Dom one thousand seven hundred and twenty six Came again as well the afd John MccClester as the afd Thomas Ralph and Jn.o Collins by their attorneys afd and whereupon the said Thomas Ralph and John Collins by their said attorney pray further Leave to Imparle hereunto untill the next Court and they have it and ye same day is given to the afd plft here also Att which said next Court to witt the twentieth day of June anno Dom One thousand seven hundred & twenty seven Came againe as well the afd John MccClester as the afd Thomas Ralph and John Collins by their attorneys afd and whereupon the said Thomas Ralph and John Collins by their said attorney as before defend the force and Injury when &c And say that the afd Jn.o MaClester his action afd against them the said Tho.s & John as afd to have & Maintain ought not because they say that they ye said Tho.s & John at ye day of the Impetration of ye originall writt of him the said John had fully administred all ye goods & Chattles which were of ye afd Jn.o Collins dec.d at the time of his Death in their hands to be administred by reason whereof the afd Tho.s & John the Debt afd to the afd Jn.o MaClester Could not pay & this they are ready to verifie whereof they pray Judgm.t if ye said John his action ag.t them to have Ought &c And whereupon the afd John MccClester by his attorney afd prays that he may have Judgm.t against the afd Thomas Ralph and John Collins of the afd two pounds Fourteen Shillings and five pence Currt money to be Levied of the goods and Chattells which were of the afd Jno Collins dec.d bring not administred, and when to the hands of the afd Thomas Ralph and John Collins should hereafter happen to Come to be administred Therefore it is Considered by the Court here the twentieth day of June anno Dom One thousand seven hundred and twenty seven that the afd John MccClester Recover against the afd Thomas Ralph and Jno Collins adm.rs as afd two pounds fourteen shillings and five pence Curr.t money whom 317 his damages afd as also three hundred & seventeen pounds of tobacco to the same Jno MccClester by the Court here adjudged unto him for his Costs and Charges by him about his suite in that part Expended to be Levied of the goods and Chattells which were of the afd Jno Collins decd at the time of his death and which to the hands of the afd Thomas Ralph and Jno Collins adm.rs as afd should hereafter happen to Come to be administred and the afd deft in Mercy &c |
