Cause to come here twelve &.c by whom &.c who neither &.c to recognize &.c becaus as well &.c
of which said Preceipt the said Sherrife to witt Francis Allen Gentleman Now hereat
to witt the same day and Year Last Mentioned comes and makes return that he hath
here ready twelve &.c as by his said Preceipt he was Commanded and now hereafterwards
to witt the same day and Year came as well the afd Plft as the afd deft by their
attorneys afd and the Jurors of that Jury therein Impannelled being called Likewise
Came to witt William Handy, Thomas Pullettt, Daniel Long, Peter Frazer, William Moar
Thomas English, William Laws, Christopher Glass, Daniel Cordery, Peter Claywell, Robert
Jones and Thomas Humphrys who being duely ellected tryed and sworn to say the truth
in the premisses afd upon their Oath do say that the afd John Bishop did not assume
^upon himselfe^ in manner and form as the plft above against him hath Complained &c

             Therefore it is considered by the Court here the twenty first day of Novem Anno
Dom one thousand seven hundred and twenty seven that the afd John Scarbrough adm.r of
the afd Ralph Holston dec.d take nothing by his writt and declaration afd but be in mercy
for his falce Clamour and that the said John Bishop goe thereof without day &c

Command was given to the sherr of Somersett County that he should take W.m
West and him should safe keep so that he might have his Body before the
Justices of his Lordship's County Court of Somersett to be held at Dividing Creek
       the third tuesday of November then next to satisfie unto Nathaniell Horsey of somersett
       County Mariner of Seven hundred and Seventy Nine pounds of tobacco for Costs and Charges
       occasioned that a Certain Jury Between the said W.m and the afd Nathaniel in a plea of trespass
       upon the Case Impetrrated and sworne their Verdict against the afd William did render
       whereof the said William is Convict and that thereof he should not fail &c

             Att which said third tuesday of Novem to witt the twenty first day of the same month
       Ann.o Dom One thousand Seven hundred and twenty Seven Being the day of the return of
       the said writt Cometh the said Nathaniel Horsey by George Dashiell his attorney and
       the said William West in Custody of the said Sherr Likewise Cometh and being sett to the
       Barr,   Thereupon the said William West at the prayer of the Plfts attorney afd is
       Committed into the Custody of the sher of Somersett County there to remain untill the said
       Nathaniel of the said Seven hundred and Seventy Nine pounds of tobacco should be fully
       Satisfyed &.c   Whereupon the said sherr present here in Court took Charge of the said
       W.m West accordingly &c
