dec.d of a plea of trespass upon the Case &c

    And whereupon the same John Scarbrough by Levin Gale his attorney Complaines
that whereas the afd John Bishop the tenth day of may one thousand seven hundred twenty
and five at somersett County afd within the Jurisdiction of this court was Indebted to the
same Ralph in his life time in the sum of one thousand pounds of tobacco for a Horse to
him by the same ralph before that time at his especiall Instance sold and delivered and so
thereof Being Indebted the said John afterwards vizt the same day and year afd at the County
afd within the afd Jur in consideration thereof upon himselfe assumed and to the same
Ralph in his life time then & there faithfully promised that he when afterwards he should
thereto be required he the afd sum of one thousand pounds of tob.o to ye same ralph he
would well and faithfully pay and content  Nevertheless the said Jno Bishop his promise
and assumption afd so as afd made Little Regarding and plotting & Fraudulently Intending the
afd Ralph in his life time and the afd John Scarbrough since his death in this part to defraud
and deceive he the afd sum of one thousand pounds of tob.o Neither to the same ralph in
his Life time nor the afd Jno Scarbrough since his death hath paid or either of them for
it in any wise satisfied altho' ye same John Bishop the same to doe the tenth day of
may Anno Dom one thousand seven hundred twenty and Six at somrsett county afd within
the afd Jurisdiction by the same Jno Scarbrough was since the death of the same ralph
thereto requested but he the same Jno Bishop the same hitherto to pay or the same John
scarbrough for it in any wise to content hath altogether refused & still doth refuse whereby
the same John Scarbrough says he is worse and hath damage to the value of two
thousand pounds of tobacco and thereof he Brings this Suite &.c  And the same
John Scarbrough Brings hereinto Court the Letters of adm.r &.c by which &c
                                                           L Gale P Quer pledges &.c Jno Doe Richd Roe

    And the said John Bishop by George Dashiell his attorney comes and defends the force
and Injury when &.c and prays leave to Imparle here unto untill the Next Court and he
hath it and the same is given unto the afd Plft here also &c

       Att which said next Court to witt the twenty first day of November Anno Dom One thousand
seven hundred and twenty Seven Came again as well the afd John Scarbrough as
the afd John Bishop by their attorneys afd and the said John Bishop by his said attorney
as before defends the force and Injury when &.c and saith Non assumsitt P.r Patriam

          Thereupon Command is given to the sherr of Somersett County that ^Immediately^ he should
