Given to the afd Plft here also &c

          Att Which said next court to witt the twenty first day of Novem Anno Dom one
thousand seven Hundred and twenty Seven came again as well the afd Thomas by his
said attorney as the afd John Murrah in his Own proper person and the said John says
that he cannot gainsay the action afd of the afd Thomas nor but that the said Edward Bray
in his Lifetime did assume upon himselfe in manner and form as the afd Thomas above
against him hath Complained nor can he say but that the said Thomas Ought to recover his
damages by occasion of the Nonperformance of the promise and assumption afd to one
thousand and twenty Seven pounds of tobacco to be levied of the goods and Chattells which were
of the afd Edward at the time of his death being not administred on and which to his hands
hereafter should happen to come to be administred &c

          Therefore it is considered by the Court here the same day and Year Last
mentioned that the afd Thomas Dashiell Recover against the afd John Murrah Executor of
the afd Hugh Porter who was Executor of Edward Bray One thousand and twenty Seven
pounds of tobacco his damages afd Above in the declaration afd Expressed as also two
hundred and fifty Nine             pounds of tobacco for his Costs and Charges by him about his suit
in that part expended to the same Thomas by the Court here of his assent adjudged to be Levied
of the goods and Chattells which were of the afd Edward Bray at the time of his death
and which to the hands of the afd John hereafter should happen to Come to be administred
and the afd Deft in mercy &c
