Thomas he would well and faithfully Content & pay Nevertheless the same Edward in His
Life time and the afd Hugh Porter since his death to whome Execution of the Last will and
testament of the said Edward afterwar the death of the same Edward was in due form of
Law at somersett County afd within the Jurisdiction of this court committed & ye afd John since the
death of the same Hugh to whom Execution of the Last will and testement of the same Hugh
since the death of the said Hugh was at Somersett County afd within the Jurisdiction of
this court in due form of Law committed the promise and assumption afd of ye afd Edward
so as afd in his Life time made Little regarding but plotting & fraudulently Intending him
the said Thomas in that part craftilly and subtilly to defraud and deceive nither the afd
Edward in his Life time Nor the afd Hugh since the death of the said Edward nor the
afd John since the death of the afd Hugh the afd sum of one thousand & twenty Seven pd.s
of tobacco nor any part thereof unto the afd Thomas hath paid or him for it in anywise
contented altho' the same Edward in his life time afterwards to witt the tenth day of may
Anno Dom one thousand seven hundred & sixteen and the afd Hugh afterw the death of
the same Edward the tenth day of may Anno Dom one thousand seven hundred & Twenty
and the afd John after the death of the same Hugh the tenth day of may Anno Dom
one thousand seven hundred & twenty Six at somrsett County afd within the afd Jur
were by the said Thomas thereto requested but they and every of them the same hitherto
to do hath altogether Refused and ^the same Jn.o the same to do^ still doth refuse to the damage of the same Thomas
three thousand pounds of tobacco and Thereof he Brings this Suite &c

    And the afd John Murrah Executor as afd by Joseph Pemberton his Attorney Comes &
defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the Next
Court and he hath it and the Same day is given to the afd Plft here also &c

          Att which said next Court to witt the twentieth day of June Anno Dom One thousand
Seven hundred and twenty seven Came againe as well the afd Thomas as the afd John by their
attorneys afd and whereupon the afd John by his Said attorney prays further Leave ^thereof^ to Imparle
hereunto untill the next Court and he hath it & the same day is given to the afd Plft here also &c

         Att which said next court to witt the fifteenth day of August Anno Dom one thousand
seven hundred and twenty seven came again as well the ^afd^ Thomas as the afd John by their
attorneys afd and whereupon the afd John by his said attorney and prays further Leave
thereof to Imparle hereunto untill the next Court & he hath it & the same day is
