Novem Court                1727                53

Now in force it stands Elected amongst other things that all persons whatsoever having
any Clame not Exceeding twenty pounds Sterr or five thousand pounds of tobacco
shall be oblidged to Sue and Implead their Severall and respected Debtors in the
severall and respected County courts where such their debters Inhabitt & not Else
where and the said Henry Being a residenter in a nother County & not where the
Action is Brought Prays Judgm.t where the plft his Action to have ought

Whereupon the afd Joseph MccClester to reply to the afd plea of the afd Henry
Smith above pleaded, Altho' solemnly called cometh not nor is his writt and declaration
^afd^ against the afd Henry further prosecuted &c

                Therefore it is Considered by the court here the twenty first day of Novem.r
Ann.o Dom One thousand seven hundred and twenty seven that the afd Joseph MccClester
and his pledges of Prosecuting that is to say John Doe and richard Roe be in mercy and
that the afd Henry Smith goe thereof without day &.c  And also it is Considered that the
afd Henry Smith recover against the afd Joseph MccClester three hundred and thirty two
pounds of tobacco for his Costs and Charges by him about his Defence in that part expended
to the same Henry by discretion of the Justices here adjudged according to the form of the
Statute in that part made and provided and that the same Henry have thereof Execution &c

                                  was attached to answer unto Thomas Dashiell of a plea of trespass
       upon the Case &c         Whereupon the same Tho.s By Levin Gale his
       attorney complains that whereas the afd Edward in his Life time the tenth day of
       may Anno Dom one thousand Seven hundred & fifteen at Somersett County within
       the Jurisdiction of this court was Indebted to the afd Thomas in the sum of one
       thousand and twenty Seven pounds of tob.o as by Acc.o here within court produced
       may appear and so thereof Being Indebted ye s.d Edward in his life time in consideration
       thereof afterwards to witt the same day and year afd at ye Co.ty afd within
       the afd Jurisdiction upon himselfe assumed and to the same Thomas then & there
       faithfully promised that he when afterwards he should be thereto Requested he
       the afd sum of one thousand and Twenty Seven pounds of tobacco to the same
