same Jos: hath not paid nor him for ye same in any wise Contented altho the same to do ye s.d Henry afterwards
to witt the tenth day of Novem Anno Dom one thousand seven hundred & twenty Six and
at the county afd within the afd Jurisdiction by the same Jos: was requested But the same Henry
the same hitherto to the same Joseph to pay or him for in any wise ^to^ Contented hath altogether
Refused and still doth refuse whereby the same Joseph says he is worse and hath damage to the
value of five thousand pounds of tob.o and thereof he Brings this Suite &c
                                                                            L Gale P Quer pledges &.c Jno Doe  Richd Roe

    And the afd Henry Smith by George Dashiell his attorney Cometh and defendeth the force and Injury
when &.c and pray the Leave to Imparle hereunto untill the next Court and he hath it and
the same day is given to the afd Plft here also &c

       Att which said next Court to witt the fifteenth day of November anno Dom One thousand
Seven hundred and twenty Six Came again as well the afd Joseph MccClester as the afd Henry Smith
by their attorneys afd and whereupon the afd Henry Smith by his said attorney prays further leave
thereof to Imparle hereunto untill the next Court and he hath it and the same day is given the
afd Plft here also &c


             Att which said next court to witt the twentieth day of June Anno Dom one thousand
Seven hundred and twenty seven Came again as well the afd Joseph McClester as ye
afd Henry Smith by their attorneys afd and whereupon the afd Henry Smith by his said attry prays
further Leave thereof to Imparle hereunto untill the nex Court and he hath it and the same
day is given the afd Plft here also &c

             Att which said next court to witt the fifteenth day of August Anno Dom one thousand
seven hundred and twenty Seven came again as well the afd Joseph MccClester as ye afd
Henry Smith by their attorneys afd and whereupon the afd Henry Smith by his said attry prays
further Leave ^thereof^ to Imparle hereunto untill the next court & he hath it and the same day is
given the afd Plft here also &c

             Att which said next Court to witt the twenty first day of Novem Anno Dom one
thousand Seven hundred and twenty Seven came again as well the afd Jos: MccClester as the afd
Henry Smith by their attorneys afd and the afd Henry Smith by his said attorney as before
defends the force and Injury when &c   And saith that the plft his action afd against him
to have ought not because he saith that According to an Act of assembly of this province
