And whereupon ye same Joseph by Levin Gale his attry Complains yt whereas ye afd Henry
after ye first day of may anno Dom one thousand seven hundred & five that is to say the
twelfth day of June Anno Dom one thousand seven hundred & twenty five at Somrsett County
within ye Jur of this Court made a certain note of in writing Called a promisary note with his
proper Hand Subscribed bearing date the same day & year Last above mentioned and ye
same which said note to the same Joseph then & there delivered by which said note the said Henry
promised to pay ye s.d Jos McClester whatsoever a certain Tho.s Pryor of ye Coty afd was
Indebted to the same Jos: when afterwards he should be thereunto requested & ye s.d Jos:
in fact says that the same Tho.s Pryor at ye time of the makeing ye Note afd was Indebted
unto the same Jos: in ye sum of two thousand five hundred & Ninety three pds of tobo
which is yet unpaid to the same Jos: whereof the same Henry afterwards (vizt) the
tenth day of Novem Anno Dom one thousand seven hundred & twenty five at Somrsett
County afd within ye Jurisdiction afd had notice which said sum of two thousand five hundred
& Ninety three pd.s of tob.o the said Henry by reason of the note afd & by force of ye statute
in such case made & provided ye s.d Henry is Chargable with & ought to pay to ye same Jos
according to the tenner of ye note afd & being so Chargable ye s.d Henry in consideration
thereof afterwards (viz.t) ye same day & year afd Last mentioned at ye Co.ty afd within
ye afd Jurisdiction upon himselfe assumed & to ye same Jos: then & there faithfully
promised that he ye s.d Henry when afterwards he should be thereto requested he ye s.d Sum
of two thousand five hundred & Ninty three pds of tob.o unto ye s.d Jos: would well & faithfully
Content & pay & also that whereas ye afd Henry ye tenth day of may Anno Dom one thousand
seven hundred and twenty six at Somersett County within the Jurisdiction of this Court was
Indebted to the same Jos: in ^one^ other sum of two thousand five hundred & Ninty three pd.s of
tob.o for ye Like sum before that time for the use of the said Joseph of a Certain Tho.s
Pryor By ye s.d Henry had & received & so thereof Being Indebted ye same Henry in Consideration
thereof afterwards to witt the afd tenth day of may Anno Dom one thousand seven
hundred & twenty Six at Somrsett Co.ty afd & within ye afd Jur upon himselfe assumed &
to ye same Jos: then & there faithfully promised that he when afterwards he should be
thereto requested he ye s.d sum of two thousand five hundred & Ninty three pd.s of tob.o
Last mentioned unto ye same Jos: would well & faithfully Content & pay Nevertheless
ye s.d Henry his several promises & assumptions afd in form afd made Little regarding
But plotting & fraudulently Intending the same Jos: in that part Craftilly & Subtilly to
defraud & deceive he ye afd Severall sums of tob.o afd or any part thereof to the
