 somersett fs    John Trewitt Jun.r late of somersett county planter was
attached to answer unto Jn.o Caldwell of a plea of trespass upon the Case &c
     And Whereupon the same John Caldwell in his Own proper person
complains that whereas the afd John Trewitt Jun.r the seventeenth day of July ann.o
Dom One thousand seven hundred and Ninteen at somersett County within the Jurisdiction of this
court was Indebted unto the afd John Caldwell in the full and Just sum of six pd.s one shill & six pence
currt mony of maryland as by his certain note herewithin court produced may appear & so thereof Being
Indebted the afd John Truett in consideration thereof afterwards to witt the same day and Year afd
at the county afd within the afd Jurisdiction upon himselfe assumed and to the same John Caldwell
then and there faithfully promised that he when afterwards he should be thereto requested the afd
sum of six pounds one Shilling and six pence Currt mony of maryland to the same Jno Caldwell
would well & faithfully Content & pay Nevertheless the said John Trewitt Junr his promise & assumption
afd in form afd made Little Regarding but plotting & fraudulently Intending ye afd John
Caldwell in that part to defraud & deceive he the said Jno Truett ye afd Sum of Six pd.s one shilling
& six pence Currt mony or any part thereof to the same Jno Caldwell altho' afterwards to witt the same
day and year afd at the county afd within the afd Jur he was thereto requested he hath not paid
nor the same John Caldwell for it in any wise Contented But the same hitherto to do hath altogether
refused and still doth refuse to the damage of the same John Caldwell of twelve
pounds three shillings Like mony & thereof he Brings this Suite &c
                                                                            Jno Caldwell Pse pledges &.c Jno Doe R Roe

       And whereupon the said John Truitt in his own proper person Comes and defends
the force and Injury when &c      And says that he Cannot gain say but that he did assume
upon himselfe in manner and form as the afd John Caldwell above against him hath declared nor
but that he owes the afd John Caldwell the afd Six pounds one shilling & six pence Currt mony
and the declaration in all the words Before Expressly Confesseth &c

          Therefore it is considered by the Court here the twenty first day of november
anno Dom one thousand seven hundred and twenty Seven that the afd Jno Caldwell Recover
against the afd Jno Truitt Six pounds one Shill and Six pence Curr.t mony his damages afd above
231    in the declaration afd Expressed as also two hundred and thirty One
110   pounds of tob.o for his costs and Charges by him about his Suite in that part Expended
by the court here of his assent to the same Jno Caldwell adjudged & the afd deft in Mercy
&c
