    Novem Court        1727                     51

MccClester lately in our county court of Somersett here to witt the fifteenth day of
march Anno Dom one thousand seven hundred & twenty five before Saml Hopkins Gent
and his associates then Justices of our said court by the consideration of the same
Court recovered against Tobias Pepper Late of Somersett County planter Nine hundred
and Sixty two pounds of tob.o which to the same Joseph in our same Court before
our Justices at dividing Creek afd were adjudged for his damages which he had By
occasion of a Certain promise & assumption to the same Joseph in the county afd
made and nor perform'd whereof he is Convict as by the record & proceeding thereof
in our same court before our Justices at dividing creek afd remaining manifestly appeareth
Nevertheless Execution of the Judgment afd as yet remaineth to be made
as by the Insinuation of the afd Joseph MccClester we have received & because we
are willing that those things which in our court afd or rightfully acted ought to be
duly executed we command you ^that^ by honest and Lawfull men of your Bailywick you
make Known unto the afd Tobias Pepper that he be before our Justices of our county
court of Somersett to be held at dividing creek the third tuesday of novem next to shew
cause if any for himselfe he hath or to say knoweth wherefore the afd Joseph MccClester
his execution against him of the damages afd to have ought not according to the form
of the recovery afd if to him it seemeth Expedient & have you then & there the Names
of them before whom to him you make the same known and this Writt Wittness &c

    Att which said third tuesday of November to witt the twenty first day of the Same
month anno Dom One thousand seven hundred and twenty seven Being the day of the
Return of the afd writt before his said Lordships Justices of the peace for the County
afd Cometh the afd Joseph MccClester in his proper person and the said sherr returned
that by vertue of his said Lordship's writt to him directed he had made known to the
afd Tobias Pepper that he before his said Lordships Justices of the County Court of
Somersett to be held at Dividing ^creek^ the day and Year afd that is to say by William Bratton
and Hutten Hill good and Lawfull men of his Bailywick &c

          And the afd Tobias Pepper altho' so before warned the same day and Year Last
mentioned being solemnly Called Cometh not but makes default

          Therefore it is Considered by the Court here the same day and Year Last mentioned
that the afd Joseph MccClester have his Execution against the afd Tobias Pepper for
Nine hundred and Sixty two pounds of tobo his damages afd as also Two hundred & six
206                  pounds of tobacco by ye Court here ^were^ adjudged ^according  to ye form of ye statute^ thereof lately made and provided for his costs
and Damages sustained by occasion of Delay of the Judgmt afd &c
