at his Especiall Instance and request Before that same time sold and delivered as by
an Acc.o thereof here^unto^of annexed and in^to^ Court Brought may more fully appear and
Being so thereof Indebted the afd Philip in Consideration thereof afterwards to
witt the same day and Year abovesaid at snow hill within the County & Jurisdiction
afd upon himselfe assumed and to the same John then & there faithfully promised y.t
he the same Philip ye afd six hundred & Eight one pounds of tob.o to ye same Jn.o
when thereof afterwards he should be required he would well & faithfully pay &
Content Nevertheless ye afd Philip his promise and assumption afd in form afd
made Little regarding but Plotting & fraudulently Intending ye same Jno in that
Part Craftilly and Subtilly to deceive and defraud the afd six hundred & Eighty
one pounds of tob.o or any part thereof to the same John hath not paid altho' the
afd Philip afterwards in the County afd within the afd Jurisdiction was by the same
John severall times required hath not paid but the same to him to pay hath denyed &
refused and still doth deny & refuse to the damage of the same John of thirteen
hundred and sixty two pounds of tob.o & thereof he Brings this Suite &c
