          November Court        1727         49

remain &.c  the said sherr Present herein Court under took Charge of the said John Esome accordingly
And afterwards in the same Court Came again the said John Esome in Custody of the Said
Sherr and defends the force and Injury when &.c and saith that he Cannot gainsay but that
he did assume upon himselfe in manner and form as the afd Joseph above against him
hath declared nor can he say but that he owes the afd Joseph the afd six pounds sixteen shillings
and six pence Curr.t mony and three hundred and fifteen pounds of tobacco and the declaration
in all the words before Expressly Confesseth &c

                         Therefore it is Considered by the Court that the afd Joseph MccClester recover
against the afd John Esome in Custody as afd the sum of Six pounds Sixteen shillings and
six pence Curr.t mony and three hundred and fifteen pounds of tobacco his damages afd above
in the declaration afd Expresed as also two hundred and sixty two                          pounds
of tobacco for his Costs and Charges by him about his Suit in that part Expended to the
same Joseph by the court hereof his assent adjudged and the afd deft in mercy &c

And afterwards viz.t the twenty first day of Novem anno Dom One thousand seven hundred
and twenty seven the said John Esome present herein Court in Custody of the Sherr of Somersett
County afd and thereupon the said John Esome at the prayer of the plfts attorney afd is
Committed againe into the Custody of the said sherr untill the said Joseph MaClester of his damages
afd should be fully satisfyed the said Sherr Present herein Court took Charge of the
said John Esome accordingly &c

    Command was given to the Sherrife of somersett ^county^
that he should take Philip Tayler late of somersett county
^planter^ if he should be found in his Bailywick and him should
          safe keep so that he might have his body before the Justices of his Lordships
    county court of somersett to be held at dividing Creek the third tuesday d of Novem
    next to answer unto John Murray of a plea of trespass upon the Case &.c and that
    thereof he should not fail &c   And ye said John Murray by Levin Gale
    his attorney decleared against the afd Philip Taylor in the plea afd as followeth
    vizt   Somersett fs   Philip Taylor late of Somersett County planter
    was attached to answer unto Jno Murray of a plea of trespass upon ye Case &c

             And whereupon ye same ^John by^ Levin Gale his attorney Complains that whereas
    the afd Philip the Eighteenth day of aprill Anno Dom one thousand Seven
    hundred and twenty Seven at snow hill in Somersett County within the Jurisdiction
    of this Court was Indebted unto the same John in Six hundred & Eighty one pd.s
    of tob.o for divers goods wares and Merchandizes by the afd Jn.o to ye same Philip
