4 And the said Patrick Mathewson being Called appears and thereupon the Said Patrick Mathewson at the prayer of the Plfts attorney afd is adjudged to give special Bail to the action afd thereupon a Certain William Bowler of Somersett County planter present here in Court undertakes for the said Patrick Mathewson that if in Case the said George Tull Shall recover Judgm.t in the plea afd against the afd Patrick Mathewson or that the said Patrick Mathewson shall be therein Convict that ^then^ he the said Patrick shall pay the Condemnation of the Court thereupon or Render his Body to the Custody of the sherr of Somersett County in satisfaction thereof or that he the said William Bowler will do it for him And the afd Patrick Mathewson in his own proper person Comes and defends the force and Injury when &c and saith that he Cannot gainsay the plft his action afd neither can he say but that he did assume upon himselfe in manner and form as the afd George Tull above against him hath declared nor then Can he say but that the same plft ought to recover his damages by Occasion of the premises afd to five hundred pounds of tobacco and the declaration in all the words before Expressly Confesseth Therefore it is Consider by the Court here the twentieth day of June anno Dom one thousand seven hundred and twenty seven that the afd George Tull Recover against the afd Patrick Mathewson five hundred pounds of tob.o his damages afd above in the declaration specified as also 271 Two hundred and Seventy One pounds of tobacco for his Costs and Charges by him about his suite in that part Expended to the same George by the Court here of his assent adjudged and the same deft in mercy &c
that whereas the afd Jn.o Collins Dec.d in his Lifetime the tenth day of May Seventeen hundred & twenty three at ye Co.ty afd within ye Jur of this Court was Indebted to the Same Jn.o MaClester in the Sum of two pd.s fourteen Shills & five pence Curr.t Money as by acc.t herewithin Court produced may appear & so thereof being Indebted the same Jn.o Collins dec.d in his Lifetime in Consideration thereof afterwards to witt ye Same Day & year afd at the County afd within the Jur afd upon himselfe assumed & to the Same Jn.o MaClester then & there faithfully Promissed yt he when afterwards he shoud be thereto requested he the afd sum of two pd.s fourteen Shill.s & five pence Currt money woud well & faithfully Content & pay Nevertheless the afd Jno Collins Dec.d in his Lifetime & the afd Tho.s ralph & Jn.o Collins his adm.rs Since the death (of) |
