Debt afd & his Dam.s by Occasion of ye Detaining of the Same Debt to one hundred
and twenty seven            pounds of Tob.o to the same Francis by ye Court here of
his assent adjudged & the afd Luke in Mercy &a

And the afd Francis Allen by his attorney afd freely here in Court Releaseth to the afd Luke
the Debt afd therefore it is Considered that the afd Luke of the Debt afd be acquitt &c

          This being an action of Debt for twenty four pounds ^six^ shillings
and Curr.t money wherein the sherr of Somersett County to whom the writt in the
                         Same action was directed Cometh and maketh Return thereof to the Court here Endorsed
viz.t Cepi Corpus P Francis Allen sher

whereupon the said Tobias Burke in his Own proper person appears and thereupon the said
Tobias Burke at the prayer of Betty Gale by Levin Gale her attorney is adjudged to give speciall
bail to the action afd thereupon a Certain Thomas Fletcher of Somersett County Clerk present here
in Court undertakes for the said Tobias Burke that if in Case the said Betty Gale shall Recover
Judgm.t in the plea afd ^against the afd Tobias Burke^ or that the said Tobias Burke shall be therein Convict that then he the said
Tobias Burke shall pay the Condemnation of the Court thereupon or Render his body to the
Custody of the sher of Somersett County in satisfaction thereof or that he the said Thomas
Fletcher will do it for him thereupon the said Tobias Burk in his own proper person appears and
Imparles till next Court &c

was attached to answer unto Geo: Tull of Dorchester Co.ty planter
of a plea of Trespass upon the Case &a
       And whereupon ye same George by Levin Gale his attry Complaines yt whereas
the afd Patrick the tenth day of June Ann.o Dom one thousand Seven hundred & twenty
Six at Somrsett Co.ty within the Jur of this Court was Indebted to ye Same George in
the sum of five hundred pd.s of Tob.o & so thereof being Indebted the said Patrick
in Consideration thereof afterward to witt the Same day & year afd at ye County
afd & within the afd Jur upon himselfe assumed & to ye Same George then & there
Faithfully Promissed yt he when afterwards he shoud be thereto requested he the
afd sum of five hundred pd.s of Tob.o to ye Same George woud well & faithfully
Content & pay Nevertheless the said Patrick his promiss & assumption afd in form
afd made Not regarding but plotting & Fraudulently Intending him the same
George in yt part Craftilly & Subtilly to Defraud & Deceive ye afd five hundred
pounds of Tob.o or any part thereof to ye Same George he hath not p.d although ye Same to doe
the afd Patrick afterwards viz.t ye same day & year afd at ye Coty afd & within the afd
Jur by ye Same Patrick was requested but he ye same hitherto to doe hath altogether
refused & Still doth refuse whereby the Same George Sayes he is worse & hath Dam
to ye value of one thousand pd.s of Tob.o & thereof he brings this suite &a
