Novem Court          1727            49

thousand Seven Hundred and twenty Six at Somersett County within the Jur of
this Court was Indebted to ye same Joseph in the sum of six pounds sixteen
shill.s & six pence Curr.t Mony for Divers Goods wares & Merchandizes to him Before
that time at his Especial Instance sold & delivered & three hundred & fifteen pounds
of tob.o for sherr Dues & officers fees as by acc.o ready in Court to be produced may
appear & so thereof Being Indebted ye s.d John in Consideration thereof afterwars to
witt the same day & Year afd at ye County afd and within ye afd Jurisdiction upon
himselfe assumed & to the same Joseph then & there faithfully promised that
he when afterwards he should be thereto requested he the afd sum of six pounds
sixteen shill.s and six pence Currt mony and three hundred & fifteen pounds
of tob.o to ye same Joseph would well and faithfully Content & pay Nevertheless
the said John his promise & assumption afd in form afd made not regarding
but plotting and fraudulently Intending him ye same Joseph in that part
Craftilly & Subtilly to defraud & deceive ye afd John ye afd sum of six pounds
sixteen Shill.s and six pence & three hundred & fifteen pounds of tobacco
or any part thereof to the same Joseph he hath not paid or him for it in any
wise Contented altho' ye same to do the afd John afterwards viz.t ye same day
and year afd at the County af and within the af Jurisdiction By ye same Joseph
was requested but he the same hitherto to do hath altogether refused & Still
doth refuse & whereby ye same Joseph says he is worse & hath damage to the
value of twelve pounds Curr.t mony & seven hundred pounds of tob.o and
thereof he Brings this Suite &c

A copy of the foregoeing declaration was made and sent to be served on the afd
deft with the writt in the plea afd &c
                       Att which said third tuesday of November to witt the twenty first day of
the same month Anno Dom One thousand seven hundred and twenty seven being the day
of the Return of the said writt Cometh the afd Joseph MccClester by his attorney afd and
the sherr of Somersett county to whom the foregoeing writt was directed Likewise Cometh
and maketh return thereof to the court here endorsed in these words following vizt
                                  Cepi Corpus declaration delivered in time P Fran Allen sher

    Whereupon the afd John Esom in his Own proper person appears and thereupon
the said John Esom at the prayer of the plfts attorney afd is adjudged to give Speciall
bail to the action afd But for want thereof the said John Esome at the prayer of the
plfts attorney afd is Committed into the Custody of the sherr of Somersett County thereto
