the defend.t with the writt in the plea afd            Att which said third tuesday of November being
the twenty first day of the Same Month Ann.o Dom One thousand seven hundred and twenty
Six Cometh ^the^ said Joseph MccClester by Levin Gale his attorney and the sherr of Somersett County
to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the
Court here Endorsed as Followeth viz.t Cepi Corpus declaration delivered in time P Fran Allen sherr

Whereupon the said Robert wair being Called appears and thereupon the said Robert
Wair at the prayer of the plft attorney afd is Adjudged to give Speciall bail to the action
afd thereupon a Certain Hugh Porter and John Davis of somersett County Planters present
here in Court in their proper persons undertakes for the said Robert Wair that if in Case the
said Joseph McClester shall recover Judgm.t against the said Robert Wair in the plea afd or that
the said Robert Wair shall be therein convict that then he the said Robert wair shall pay ye
condemnation of the Court thereupon or render his body to the custody of the sher of Somersett
county in Satisfaction thereof or that they the said Hugh Porter and John Davis will do it for him

       Whereupon the afd Robert Wair in his Own proper person Cometh and defendeth the
force and Injury when &.c and saith that he cannot gainsay but that he did assume upon himselfe
in manner and form as the afd Joseph above against him hath declared nor but that he owes
the afd Joseph Eighteen hundred and Eighty five pounds of tobacco and the declaration in all
the words before Expressly confesseth

                            Therefore it is Considered by the Court that the afd Joseph MccClester
Recover against the afd Robert Wair Eighteen hundred hundren and Eighty five pounds
of tobacco his damages afd in form afd Confessed as also two hundred and Ninty Six
296         pounds of tobacco for his Costs and Charges by him about his Suite in that part
expended by the Court hereof his assent adjudged and the afd deft in mercy &c

      Command was given to the Sherr of somersett County that he
should take John Esom late of Somersett County planter if he shall be
found in his Bailywick and him should safe keep so that he might have
                      His Body Before the Justices of his Lordships county Court ^of Somersett^ to be held at Dividing
             Creek the third tuesday of Novem then next to answer unto Joseph MaClester
       late sherr of somersett County of a plea of trespass upon the Case &.c and that thereof
       he should not fail &c
                                                 And the said Joseph MccClester by Levin Gale His
       attorney decleared against the afd John Esome in the plea afd as followeth viz.t

Somersett fs:  John Esom late of Somersett County Planter was attached to answer
unto Joseph MccClester late sherr of Somrsett County of a plea of Trespass upon
the Case &c      And whereupon ye same Joseph By Levin Gale his
attorney Complains y.t Whereas the af.d John the tenth day of may Anno Dom one
