              Novem Court       1727            47

the said John Breedy or that the said John Breedy shall be therein Convict that then he the said
John Breedy shall pay the Condemnation of the Court thereupon or render his Body to the Custody of
the sherr of Somersett County in Satisfaction thereof or that they the said Levin Gale and George
Dashiel will do it for him &c

          And the said John Breedy in his Own proper person Comes and defends the force and Injury
when &.c and saith that he Cannot gainsay but that he did assume upon himselfe in manner & form as
the afd Joseph MccClester above against him hath declared nor but that he owes the afd Joseph the
afd thirteen hundred and forty seven Pounds of tobacco and the same declaration in all the words
before Expressly Confeseth
                                                          Therefore it is Considered by the Court that the afd Jos
MccClester recover against the afd John Breedy thirteen hundred & forty seven pounds of
tobacco his damages afd above in the declaration afd Specified as also Two hundred & Eighty four
284                     pounds of tobacco for his Costs and Charges by him about his suite in that part Expended
to the same Jos by the Court here of his assent adjudged & the same deft in Mercy &c

Pse  Robert Wair
 Command was given to the sherr of Somersett County that he should
take Robert Wair Late of Somersett County Planter if he should be
found in his bailywick and him should safe keep so that he might
                have his Body Before the Justices of his Lordships county court of Somersett to be
    held at Dividing Creek the third tuesday of November then next to answer unto Joseph MccClester
    late sherr of Somersett County of a plea of trespass upon the Case &.c and that thereof he
    should not fail &c
                                     And the said Joseph MccClester by Levin Gale is attorney Complaines
    against the afd Robert Wair in the plea afd as followeth vizt

                                  Robert Wair late of Somersett County planter was attached to
    Answer unto Joseph MccClester late sherr of Somersett County of a plea of trespass upon
    the Case &c            And whereupon the same Joseph by Levin Gale his attorney Complains
    that whereas the afd robert the tenth day of Novem Anno Dom One thousand Seven
    hundred and twenty six at Somersett County within the Jurisdiction of this Court was
    Indebted unto the same Joseph in the sum of two thousand six hundred and twenty pd.s
    of tobacco for sherr fees Dues and Officers Fees as by acc.ot herewithin Court ready to be
    produced may appear and so thereof being Indebted the said Robert in Consideration thereof
    afterwards to witt the same day and Year afd at the County and within the Jurisdiction
    afd upon himselfe assumed and to the same Joseph then and there faithfully promised
