then and there faithfully promised that he when afterwards he should be thereunto requested
he the afd sum of thirteen hundred and forty seven pounds of tobacco to the same Joseph
would well and faithfully content and pay Nevertheless the said John his promise and
assumption afd in form afd made not regarding but Plotting and fraudulently Intending
him the same Joseph in that Part Craftilly and Subtilly to defraud and deceive the afd
John the afd sum of thirteen hundred and forty Seven pounds of tobacco or any part
thereof to the same Joseph hath not paid or him for it in any wise Contented altho'
the same to do the afd John afterwards vizt the same day and Year afd at the County
afd and within the afd Jurisdiction by the same Joseph was requested but the same
hitherto to do hath altogether denyed and Still doth deny whereby the same Joseph saith
that he is worse and hath damage to the Value of three thousand pounds of tobacco and

A Copy of the foregoeing Declaration and account were made and Sent to be served on
the afd Jn.o Breedy with the writt in the plea afd

       Att which said third tuesday of November to witt the twenty first day of the same
       month Anno Dom one thousand Seven hundred and twenty seven being the day of the
       Return of the said Writt Cometh the said Joseph MccClester by his attorney afd and the
       Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh
       and maketh return thereof to the Court here Endorsed in these words viz.t  Cepi Corpus
       declaration delivered in time      Francis Allen sherr

             Whereupon the said John Breedy being Called appears and thereupon the said
       John Breedy at the prayer of the Plfts attorney afd is adjudged to give speciall bail
       to the action afd Thereupon a Certain Levin Gale and George Dashiell of the County
       afd Gent Present here in Court in their proper persons undertakes for the said John Breedy
       that if in Case the said Joseph MaClester shall recover Judgmt in the plea afd against
