1727 46 she putts herselfe upon the Country and George Dashiell who for his said Lordship in this Behalfe prosecutes Likewise Thereupon command is given unto the sherr of Somersett County that Immediately he Cause to come here twelve &c who &c to recognize &c because as well &c of which said preceipt the said Sherr to witt Francis Allen Gent Now hereat this twenty first day of Novem Anno Dom One thousand Seven hundred and twenty seven Came the said sherr & made return that he hath here ready twelve &.c as by his said preceipt he was Commanded and the Jurors of that Jury therein Impannelled being Called Came to witt William Handy Daniel Long Thomas Pullett, Peter Frazer William More, Thomas English, Wm Laws Christopher Glass Abraham Smith, Peter Claywell, Robert Jones Thomas Humphry's who being Duely elected tryed and Sworn upon their Oath do say that the afd Patience Evans Diton is not guilty of the felony whereof She stands Indicted &c Therefore it is Considered that the afd Patience Evans Diton of the same felony be acquitt &.c and goe thereof without day &.c whereupon the said Patience Evans Diton is discharged and Jn.o Merrill her master undertakes to deliver the said Patience Evans Diton up to the County Court of Somersett or to the sherr of said County at the Expiration of her Servitude to reemburst to the said County the Severall Officers their fees due by Occasion of the premisses afd &c
held at Dividing Creek the third tuesday of November then next to answer unto Joseph MccClester of a plea of trespass upon the Case &.c and that thereof he should not fail &c And the afd Joseph MccClester by Levin Gale his attorney Complaineth against the afd John Breedy in the plea afd as followeth viz.t Somersett fs John Breedy late of Somersett County Planter was attached to answer unto Joseph MccClester late sherr of Somersett County of a plea of trespass upon the Case &c And whereupon the same Joseph by Levin Gale his attorney Complains that whereas the afd John the tenth day of Novem.r Anno Dom One thousand seven hundred & twenty six at somersett County within the Jurisdiction of this Court was Indebted unto the same Joseph in the sum of thirteen hundred and forty Seven pounds of tobacco as by acco.t herewithin Court produced may appear and so thereof being Indebted the said John Breedy in Consideration thereof afterwards to witt the same day and Year afd at the County afd and within the afd Jurisdiction upon himselfe assumed and to the same Joseph MccClester then |
