35 Att which said Next Court to witt the fifteenth day of august ann.o Dom One thousand Seven Seven hundred and twenty Seven Came again as well the afd Richard Chambers as the afd Edmond Dickenson by their attorneys afd and the afd Edmond Dickenson by his said attorney as before defends the force and Injury when &.c and says that he is not guilty of the premisses as the plft above against him hath Complained and for tryall thereof he putts himselfe upon the Country &c and ye Plft likewise &c Thereupon Command is given unto the sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which said Preceipt the said Sherr to witt the Francis Allen Gent was hereat ^this day to^ to witt the same day and year Last mentioned makes Return that he hath here ready twelve &c as by his said preceipt he was Commanded and Now hereafterwards to witt the same day and year Came as well the afd Plft as the afd deft by their attorneys afd And the Jurors of that Jury therein Impannelled being Called Likewise Came to witt William Lane, Edward Jones, Richard Holland John Pope, Thomas Cary, John Townsend Jun.r, John Purnall, John Holland, James Thompson Christopher Glass, William Furnace, and Robert Collier who being duely Elected tryed and Sworn to Say the truth of the premisses upon their Oath do Say that the afd Edmond Dickenson is Guilty of the premisses as the Plft above against him hath Complained and do assess the damages of the same Richard beyound his Costs and Charges by him about his suite in that part Expended to forty five shillings Currt mony and for those Costs and Charges to One pounds of tobacco &a Therefore it is Considered by the Court here that the afd Richard Chambers Recover against the afd Edmond Dickenson forty five shillings Curr.t mony ^and one pound of tobacco^ his damages afd by the Jurors afd in form 937 afd assessed as also Nine hundred & thirty Seven pounds of tobacco for his Costs and Charges afd to the afd Richard by the Court here of his assent of Increas adjudged which Certain damages in the whole do amount unto forty five shillings Currt money and pounds of tobacco and the afd Deft in Mercy &c
And whereupon the same Jn.o by Levin Gale his attry saith yt whereas the afd Tho.s ye day of Ann.o Dom one thousand seven hundred & twenty at Somrsett Co.ty within ye Jur of this Court by his Certain Writing Obligatory Granted himselfe to be held & firmly bound unto ye same Jn.o in the afd Sum of Seven pds Eighteen Shills & three pence Currt mony to be paid ye same Jn.o when afterwards ye s.d Tho.s shoud be thereto required yet ye afd Tho.s though often thereto required ye s.d Sum of Seven pd.s Eighteen Shills & three pence Curr.t mony to ye (same) |
