34 Altogether denyed & still doth deny to ye Dam of same Archabald of fourteen pd.s Eigh Nineteen Shills Like money & thereof he Brings this suite &a L Gale P Quer pledges &.a Jno Doe Richd Roe And the afd Mary Woodcraft Exrx of ye afd Tho.s Wildgoes by Geo: Dashiell her attry Comes & Defends the force & Injury when &.a & prayes Leave to Imparle here unto untill ye Next Court & he ^still^ hath it & the same day is given unto the afd Plft here also &a Att which said Next Court to witt ye fifteenth day of August Ann.o Dom one thousand seven hundred & twenty Seven Came againe as well the afd Archibald Smith as the afd Mary Woodcraft Exrx as afd by their attorneys afd and the said Mary Woodcraft by her said attorney as before defends the force and Injury when &c and saith that he Cannot gainsay the Action of the afd Archibald nor but that the afd Thomas Wildgoos in his Life time was Indebted unto the afd Archabald the afd seven pounds Nine shillings and Nine pence lawfull mony of america nor Can he say but that the same Ought to be Con Levied of the goods and Chattells which were of the afd Thomas being not administred on and which to the hands of the afd Mary shall happen hereafter to Come to be administred together with his damages by occasion of the detaining of the Same debt to him to be adjudged &c Therefore it is Considered by the Court that the afd Archibald Smith Recover against the afd Mary Woodcraft Exrx of the same Thomas Willdgoose seven pounds Nine shillings and Nine pence Lawfull mony of America his debt afd as also his damages by Occasion of the detaining of the same 292 debt to Two hundred & Ninty Two pounds of tobacco by the Court here of his assent adj to the same Archibald Adjudged to be Levied of the goods and Chattells which were of the afd Thomas Wildgoos at the time of his death being not administred on and which time the hands of the afd Mary ^Executrix as afd^ shall here^after^ happen to Come to be administred and ye afd Deft in Mercy &c
being Possessed ye same Rich.d the said Mare afterwards out of his hands & possession Causually Lost which said Mare afterwards to witt ye same day & year afd at ye Co.ty afd within ye afd Jno to ye Hands & Possession of ye af Edmond by finding Came Nevertheless the said Edmond Knowing the afd Mare to be the proper Mare of him ye s.d Rich.d & to him of Right to belong plotting & fraudulently Intending the same Rich.d in y.t part Craftilly & Subtilly to Defraud & deceive the Mare afd though often thereto requested to ye same Richard hath not Delivered but the said Edm.d ye said Mare afterwards to witt ye same day & year afd at the Co.ty afd & within the afd Jur to his own proper use did Convict & Dispose whereby ye same Richd Says he is worse & hath Dam to ye Value ^of^ Twelve p.ds Currant Money & thereof he Brings this suite &a L Gale P Quer pledges &.a Jno Doe R Roe And the afd Edm.d Dickeson by Geo: Dashiell his attry Comes & Defends the force & Injury when &a And Prays Leave to Imparle hereunto untill ye Next Court & he hath it & the same Day is given unto the afd Plft here also &a Att |
