34 Somersett County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &c to Recognize &c because as well &c of which said preceipt the Said sherr to witt Francis Allen Gent now hereat this day to witt the same day and year Last mentioned makes return that that he hath here ready twelve &c as by his said preceipt he was Commanded and Now hereafterwards to witt the Same day and year Came as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt W.m Lane, Edw.d Jones,, Richard Holland, John Pope, Thomas Cary, John Townsend, Henry Toadvine John Holland, James Thompson, Christopher Glass, W.m Furnis and Robert Collier who being duely Elected tryed and Sworn to say the truth in the premisses upon their Oath do say that the afd Nathaniel Horsey did assume upon himselfe in manner and form as the afd William West above against him hath Complained and doe assess the damages of the Same William to six shillings and four pence &.c wherefore the damages afd found being not within the Jurisdiction of this Court to give Judgm.t on the Verdict afd for the Plft Therefore it is Considered by the Court here that the afd William West take nothing for ^by^ his writt and declaration afd but be in Mercy for his falce Clamour and that the afd Nathaniel Horsey goe thereof without day &c also it is Considered that the afd Nathaniel Horsey recover ag.t 779 the afd Wm West Seven hundred and Seventy Nine pounds of tobacco for his Costs and Charges by him about his defence in that part Expended to the Same Nathaniel by the Court here according to the form of the Statute in such Cases thereof Lately made and provided adjudged and that ye same deft have thereof Execution &c
And whereupon ye same Archabald by Levin Gale his attry saith yt whereas ye same Archabald at ye Court of Comon pleas held for Sussex Co.ty upon Delaware viz.t at Somrsett Co.ty within ye Jur of this Court the fourth day of Novem Anno Dom one thousand seven hundred & twenty three by the Judgm.t of the same Court Recovered against the afd Mary Woodcraft as Exrx of ye Last will & Testement of the same Thos Wildgoes the afd Sum of Seven pd.s Nine Shills & Nine pence Lawfull mony of America as apears by Transcript of the Records of ye sd Court hereinto Court Brought may apear on which said Judgm.t ^Execution^ hath Never yet Issued by which Action hath Accrewed to ye same Archabald to have & require of the afd Mary Woodcraft the said Sum of seven pd.s Nine Shills & Nine pence Nevertheless ye same Mary though often thereto required the said Sum of Seven pd.s Nine Shills and Nine pence to ye Same Archabald hath not Rendered but ye same Mary the same Hitherto to render Hath (altogether) |
