the afd Thomas Brereton the sum of Seven hundred & fourteen                                                           pounds
714   of tobacco for his Costs and Charges by him about his defence in that part Expended by the Court here
or 614   according to the form of the statute in such Case Lately made and provided adjudged &c

 Somersett fs  Nathaniel Horsey Late of Somersett County Marriner was attached to answer
unto William West of a plea of trespass upon the Case &c
And whereupon the same W.m by Levin Gale his attry Complaines that
whereas ye afd Nath.ll ye tenth day of June Ann.o Dom one thousand seven hundred & twenty three
at Somrsett Co.ty within the Jur of this Court was Indebted to ye same W.m in ye sum of three
hundred & thirty pd.s of Tob.o & three pd.s fourteen Shills & one penny Curr.t Money as by an acc.t
hereunto Annexed & into Court Brought Reference being thereunto had may More fully appear
& so thereof being Indebted ye said Nath.ll in Consideration thereof afterwards to witt the same
day & year afd at the Co.ty afd & within ye afd Jur upon himselfe assumed & to ye same W.m here
& there faithfully Promissed that he when afterwards he should be thereto requested he ye afd
sum of three hundred pds & thirty pd.s of Tob.o & three pd.s fourteen Shill.s & one penny Curr money
to ye same W.m would well & faithfully Content & pay Nevertheless ye said Nath.ll his promiss
& assumption afd in form afd Made Not regarding Butt Plotting & Fraudulently Intending
him the same W.m in that part Craftilly & Subtilly to Defraud Deceive ye afd three hundred &
thirty pd.s of Tob.o & three pd.s fourteen Shill.s & one penny Curr.t mony or any part thereof to the
same W.m he hath not paid although ye same to doe ye afd Nath.ll afterwards viz.t ye same
day & year afd at ye Co.ty afd & within ye afd Jur by ye same ^Wm^ was requested but the ye same hitherto
to doe hath altogether refused & Still doth refuse whereby ye same W.m say he is worse &
hath Dam to ye value of six hundred & sixty pd.s of Tob.o & seven pd.s Currt money & thereof he

and prays Leave to Imparle hereunto untill ye Next Court & he hath it & the same day is given unto
the afd Plft here also &c

Att which said next Court to witt the fifteenth day of August Anno Dom One thousand seven hundred
and twenty Seven Came again as well the afd William West as the afd Nathaniel Horsey by their
attorneys afd and the said Nathaniel Horsey by his said attorney as before defends the force and
Injury when &.c and says that he did not assume upon himselfe in manner and form as the plft
above against him hath Complained and for tryall thereof putts himselfe upon the Country &c
and ye afd Plft in Like manner  
                                                                   Thereupon Command is given to the sher of
