    August Court       1727         33

Reason of the speaking asserting Publishing & Declaring of which false Malicious
Infamous Scandelous & approbias words ye same Tho.s not only in his good Name
fame Creditt & Estimation afd is Much hurt & Damnified but alsoe sundry
Sums of Money & Tob.o for Clearing up his Innocency in yt part is forced to Expend
Whereupon he saith he is worse & hath Dam to ye value of thirty pd.s Lawfull
Money of Maryland & thereof he brings suite
                                                          Dashiell P Quer pledges J Doe Richd Roe

And the afd Mathew Hosia by Levin Gale his attorney Comes and defends the force and Injury
when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the Same
day is given unto the afd Plft here also &c

Att which said next Court to witt the twentieth day of June anno Dom One thousand seven hundred
and twenty seven Came againe as well the afd Thomas Brereton as the afd Mathew Hosia by their
attorneys afd and the afd Mathew Hosia by his said attorney thereupon prayed further Leave
to Imparle hereunto untill the next Court and he hath it and the same day is given unto the
afd Plft here also &c

          Att which said next Court to witt the fifteenth day of august anno Dom One thousand seven
hundred and twenty seven Came again as well the afd Thomas Brereton as the afd Mathew Hosia
by their attorneys afd and the said Mathew Hosia by his said attorney as before defends the force and
Injury when &c   and says that he is not guilty of the premisses above upon him Imposed
in manner and form as the afd Thomas against him hath Complained and of this he putts himselfe
upon the Country &c   and ye Plft in like manner

          Thereupon Command is given to the sherr of Somersett County that Immediately he Cause
to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which
said Preceipt the said Sherr to witt Francis Allen Gent Now hereat this day to witt the Same day
and year Last mentioned makes Return that he hath here ready twelve &c as by his said
preceipt he was Commanded and now hereafter to witt the same day and year Comes as well
the afd Plft as ye afd deft by their attorney afd and the Jurors of that Jury therein Impannelled
being Called Likewise Came to witt Wm Lane, Edwd Jones, Richard Holland, Thomas Cary, John
Townsend Jun.r, Henry Toadvine, James Hardy, John Holland, James Tompson, Christopher Glass, W.m
furnis and Robert Collier who being duely Elected tryed and sworn to say the truth in the premisses
upon their Oath do say that the afd Mathew Hosia is not guilty of the premisses as the afd
Thomas Brereton above against him hath Complained &c

       Therefore it is Considered by the Court her that the afd Thomas Brereton take nothing by his
writt and declaration afd but be in mercy for his falce Clamour and that the afd Mathew
Hosia goe thereof without day also it is Considered that the afd Mathew Hosia recover against
