1727 32 seven ^hundred and twenty seven^ Came again as well the afd Stephen Costan as the afd Matha Hosea by their attorneys afd & the afd Mathew Hosea by his said attorney thereupon prayed further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given ^un^to the afd Plft here also &c Att which said next Court to witt the fifteenth day of ugust anno Dom one thousand seven hundred and twenty seven Came again as well the afd Stephen Costan as the afd Mathew Hosea by their attorneys afd and the afd Mathew Hosea by his said attorney as before defends the force and Injury when &c And says that he is not guilty of the premisses above him Imposed in Manner and form as the afd Stephen ag.t him hath Complained and of this he puts himselfe upon the Country &c and the afd Plft Likewise And whereupon the afd Stephen Coston his writt and declaration afd against the afd Mathew Hosea did not Prosecute with Effect but voluntarily suffered his suite to be discontinued Therefore afterwards viz.t that same day by discretion of the Justices here were adjudged 307 the same Mathew Hosea the sum of three hundred & seven pounds or 208 of tobacco for his Costs and Charges by him about his defence in that part Sustained according to the form of the statute in Such Case thereof Lately made and provided and the afd Stephen Coston in Mercy and that the afd Mathew Hosea have thereof Execution &c
that now is & as such from ye time of his Nativity hitherto hath Behaved & Demaned himselfe & from all Ruid of Theft Larceny Fellony or any Such Wicked & Base Crime or any Blott or Suspetion of the Same from the time of his Nativity hitherto free and Unatainted Untouched & unsuspected hath Lived behaved held & Governed himselfe & of a good Name fame Estimation & Creditt by ye whole time afd was held & Reputed & Called Nevertheless ye same Mathew Being not Ignorant of the premisses but Invying the Happy Estate & Condition of ye said Tho.s & Maliciously plotting & Intending him ye same Tho.s in his good Name fame Creditt & Estimation afd to hurt & Detract & him ye same Tho.s unto Trouble Vixation & Infamy to Induce & to Cause him ye Same Tho.s Innocently to be Brought into Danger of forfeiting fourfold suffering Corporall Punishment & the Pillowry as ye Law in such Cases Directs ye Last day of Janry Anno Dom one thousand seven hundred & twenty six at stepny in Somrsett Coty afd within ye Jur of this Court ye same Mathew Haveing Communication & Speech with severall ye good people of this province Leige Subjects of our Lord ye King yt now is these false scandelous Malicious & approbious words & Lies with an Audible Voice of him the same Tho.s Maliciously did Pronounce assert rehearse Publish & speak vizt that Tho.s Brereton speaking of & Meaning ye afd Tho.s was a hogg stealling rogue & he ye same Mathew would make a hogg Stealing dogue of him ye s.d Tho.s Meaning by (reason) |
