31 that whereas the said Rob.t is a good True faithfull and Honest Leige Subject of our Lord the King that now is & as such from ye time of his Nativity hitherto hath Behaved himselfe & from all Kind of Theft Larciny Felony or any Such Wicked & Base Crime or any Blott or suspection of the same from ye time of his Nativity hitherto free & unatainted untouched & unsuspected hath lived Behaved held & Governed Himselfe & of a good Name fame Creditt & Estimation by the whole time afd was held & reputed Nevertheless the said W.m being not Ignorant of the Premisses but Enviing the Hapy Estate of & Condition of ye said Rob.t & Maliciously Plotting & Intending him the said Robert in his good Name fame Creditt & Istimation afd to hurt & Detract & him ye same Rob.t into Trouble Vexation & Infamy I to Induce & to Cause him ye said Rob.t Innocently to be Brought Into Danger of forfeiting fourfold & suffering Corporall Punishm.t & ye Pillory as ye Law in such Cases Directs ye twenty six day of Novem Anno Dom one thousand seven hundred & twenty six at the Parish & Coty afd within ye Jur of this Court haveing Communication & Speach with W.m him ye said Robert in presents & Hearing of sundry Faithfull Leige Subjects of our Lord ye King these false feigned Infamous Scandelous Malicious & aprobias Words & Lies with an Audible Voice to & of him ye s.d Rob.t Maliciously did pronounce assert rehearse Publish & Speak viz.t you speaking of and Meaning the afd Rob.t was a David Hogg Stealing Sone of a bitch for he Stole two Hoggs & he the same W.m Haymon himselfe Meaning) would prove itt by Reason of speaking asserting Publishing & Declareing of which fals Malitious Infamous Scandalous & aprobias words ye said W.m not only in his good Name fame Creditt & Estimation afd is Much hurt & Damnified but also sundry sums of Money of & Tob.o for Clearing up his Innocency in yt part is force to Expend whereupon he saith he is worse & hath Damage to the value of fifty pounds Curr.t Money of Maryland & thereupon he Brings Suite Dashiell P Quer Pledges Jno Doe Richard Roe And the afd William Hayman by Levin Gale his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto unto untill the next Court and he hath it and the same day is given unto the afd Plft here also &c Att which said next Court to witt the twentieth day of June anno Dom One thousand seven hundred and and twenty seven Came againe as well the afd Robert Adkins as the afd William Hayman by their attorneys afd and the afd William Hayman by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given unto the afd Plft here also &c Att which said Next Court to witt the fifteenth day of august anno Dom One thousand Seven hundred and twenty Seven Came againe as well the afd Robert Akins as the afd William Hayman by their attorneys afd and the said Charles William Hayman says that he Cannot gainsay the action afd nor Can he say but that he is guilty of speaking and publishing the words Laid in the plft declaration afd and that the said words were falce and feigned and that he had wronged the same plft by uttering of ye same words &c Therefore it is Considered by the court that the afd Robert Adkins Recover against the afd Wm Hayman 1500 his damages afd as also the sum of one thousand five hundred pounds of tobo by the Court here adjudged unto the same robt for his Costs and Charges and ye afd deft in mercy &c wherefore ye afd plft freely here in Court Remitted ye afd deft from ye Dam.s &c therefore ye sd Deft of ye same dams be acquitt &a |
