30 Att which said next Court to witt the twentieth Day of June Anno Dom one thousand Seven hundred and twenty seven Came again as well the afd Alex.d Marcy by his attorney afd as the afd William Freeman in his own Proper person and the said W.m Freeman in his own Proper person thereupon prayed further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given unto the afd Plft here also Att which said next Court to witt the fifteenth day of august ann.o Dom one thousand seven hundred and twenty seven Came again as well the afd Alexander Marcy by his attorney afd and prays that the same W.m Freeman to his declaration afd may answer but the said William Freeman altho' at the same day Solemnly Called cometh not nor nothing saith in Barr or preclusion of the action of the afd Alexander Marcy by which the same Alexander remaineth against the afd William thereof undefended &c Therefore it is Considered by the Court ^here^ that the afd Alexander Marcy Recover against the afd W.m Freeman seven thousand pounds of tobacco his debt afd and his damages by Occasion of the 438 detaining of the same debt to four hundred and thirty Eight pounds of tobacco to the same Alexander of his assent by the Court here adjudged and the afd Deft in mercy &c
Co.ty af with the Jur of this Court was Indebted to ye said Jn.o in ye sume of two thousand Seven hundred pence for a horse which ye said Jn.o Bishop at ye Especiall Instance & request of ye said Geo: Sold & Delivered & ye said Geo: being Indebted as afd for & Inconsideration afd at ye time & place afd upon himselfe did assume & to ye said Jn.o then & there did faithfully promise that ye afd two Thousand seven Hundred pence he would well & truly Content & pay when he Should be thereto requested (and altho afterwards to witt ye same day and year afd at ye Coty afd within ye afd Jur: he was thereto requested) he hath not paid nor ye same Jn.o in any ways for ye same pence Contented but ye same to doe hath Refused & still doth refuse to ye Damage of ye same Jn.o of five thousand four hundred pence & thereof Brings Suite &a Dashiell P Quer Pledges &.a Jno Doe Richd Roe And the afd Geo: Pope by Levin Gale his attry Comes & Defends the force & Injury when &a And prayes Leave to Imparle hereunto untill the Next Court & he hath it and the Same Day is Given unto the afd Plft here also &a Att which said Next Court to witt ye twentieth day of June Anno Dom one thousand seven hundred & twenty Seven Came again as well the afd Jn.o Bishop as the afd Geo: Pope by their attrys afd and ye afd Geo: Pope by his said attry prayed further Leave to Imparle hereunto untill the Next Court & he hath it and the same day is given unto ye afd Plft here also &a Att which said next Court top witt the fifteenth day of August Anno Dom One thousand seven hundred and twenty Seven Came again as well the afd John Bishope as the afd George Pope by their attorneys |
