28 Manner and form as the Plft against them hath Complained & of this they put themselves upon the Country and the afd Plft in Like Manner &a Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which said preceipt the said Sherr to witt Francis Allen Gent Now here at ^this day^ to witt the Same day and year Last mentioned Comes and makes Return that he hath here ready Twelve &c as by his said preceipt he was Commanded and now here afterwards to witt the same day and year Came as well the afd Plft as the afd defts by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt John Pope Edwd Jones, Richard Holland, Thomas Cary, John Townsend Jun.r Henry Toadvine, James Hardy John Holland, James Thompson, Christopher Glass, William Furnace Robert Collier, who being duely Elected tryed and Sworne to Say the truth in the premisses and after the same Jurors were by the Court Charged Concerning their Verdict and from the barr here to Commune together amongst themselves of and Concerning their giving in of the Verdict afd in the premisses afd did recede and thereof amongst themselves being fully agreed Came againe to the barr to give in that Verdict but the said Southy Whittington altho' Solemnly Came not nor is his writt afd further prosecuted against the afd John & Thomas Sumers &c Therefore it is Considered by the Court here that the afd Southy Whittington take nothing by his writt afd but that he and his pledges of prosecuting that is John Doe and Richard Roe be in mercy and that the afd John and Thomas Sumers goe thereof without day &c and further it is Considered that the afd John and Thomas Sumers Recover against the afd Southy Whittington six hundred and Nine 609 pounds of tobacco for his Costs and Charges by him about his Suite in that part Sustained to the same John and Thos Sumers by the Court here adjudged according to the form of the statute in such Case Lately made and provided and that the same defts have thereof Execution &c
and twenty five at Somersett County within the Jur of this Court was Indebted unto the same Joseph in the Sum of Six hundred and twelve pounds of tob.o as by an Acco thereof hereunto annexed and herein Court brought may More fully appear and so thereof being Indebted the said Jacob in Consideration thereof afterwards to witt the same day and Year afd at the Co.ty afd and within the afd Jurisdiction upon himselfe assumed and to the Same Joseph then and there faithfully promissed that he when afterwards he should be thereto Requested he the afd sum of six hundred and twelve pounds of tob.o to the same Jos would well and faithfully Content |
