August Court
1727 28 Att which said Next Court to witt the fifteenth day of August ann.o Dom one thousand seven hundred and twenty six Came again the partyes by their attorneys afd and whereupon all and singular the premisses being seen and fully read and mature deliberation thereupon had it seemeth to the Court here that the declaration afd of the same John Parker in manner and form above declared and the matter in the same specified are not Sufficient in the Law &c Therefore it is Considered by the Court that the afd John Parker take nothing by his declaration afd and that the same Jn.o Parker be in mercy and also that the afd Isaac Rappoon as to the premisses afd goe without day &c
Jn.o & Tho.s Sumers ye tenth day of June Ann.o Dom one thousand seven hundred & twenty six at Somrsett Co.ty within the Jur of This Court with force & arms the Fence of ye said Southy did throw Down and the Logs of the said Fence of the Value of forty shills did Take & Carry Away & other harms to him then & there did Doe to the Great Dam.s of the said Southy & against the peace of the Right Honrble the Lord Proprietor of this province whereby ye same Southy sayes he is worse & hath Dam to ye value of Ten pd.s Cur money and Thereof he Brings this Suite &a Levin Gale P Quer Pledges &.a J Doe R Roe And the said Jno & Thos Sumers by George Dashiell their attry Comes & Defend the force and Injury when &a And prays Leave to Imparle hereunto untill the Next Court and they have it & the same Day is given unto the afd Plft here also &a Att which said Next Court to witt ye fifteenth day of Novem Ann.o Dom one thousand seven hundred & twenty six Came again as well the afd Southy Whittington as the afd Jn.o & Tho.s Sumers by their attrys afd & the afd Jn.o & Tho.s Sumers by their said attry Thereupon pray further Leave to Imparle hereunto untill the Next Court & they have it & the same day is given unto ye afd Plft here also &a Att which said Next Court to witt ye twenty first day of March Ann.o Dom one thousand Seven hundred & twenty six Came again as well the afd Southy Whittington as the afd Jn.o & Tho.s Sumers by their attrys afd & the afd Jn.o & Tho.s Sumers by their said attry Thereupon pray further leave to Imparle hereunto untill ye Next Court & they have it & the same day is given unto ye afd Plft here also &a Att which said Next Court to witt ye twentieth day of June Anno Dom one thousand seven hundred & twenty seven Came again as well the afd Southy Whittington as ye afd Jn.o & Tho.s Sumers by their attrys afd & the afd Jn.o & Tho.s Sumers by their said attry Thereupon pray further Leave to Imparle hereunto untill ye Next Court & they have it & ye same day is given unto ye afd Plft here also &a Att which said Next Court to witt ye fifteenth day of August ann.o Dom one thousand seven hundred & twenty seven Came again as well the afd Southy Whittington as ye afd Jn.o & Tho.s Sumers by ^their^ attrys afd & ye afd Jn.o & Tho.s Sumers by their said attry as before Defends the force & Injury when &a and says that they are not Guilty of the Premisses above upon them Imposed in (manner) |
