Sterlling and the Said John Carr, Thomas Hooffington, John Watson and James Smith in the Sum of fifty shillings Ster Each due to be Levied on their Goods or Chattells Lands and tenements for the Use of his Said Lordship if default be made in the Condition hereunder written The Condition of the above Recognizance is Such that if the above Named William Twyford be of the Peace and good behaviour to all his Lordship Good Subjects and Especially to John Newton of the said County and Make his personall appearance before the Justices of Our Said County Court to be led at dividing Creek the third tuesday of June next and stand and abide the Judgmt of the Said Court then this recognizance to be void and of none Effect else to remaine in full force and vertue in law Jno Caldwell Att which said next Court to witt the Sixteenth day of June Anno Dom One thousand Seven hundred and thirty the afd William Twyford altho' Solemnly Called Came not nor Shews Cause why &.c but Makes default Likewise at the Same day the afd John Carr, Thomas Hooffing^ton^, John Watson and James Smith and Every of them being Solemnly Called to bring in the Said W.m Twyford according to the tenor of their Recognizance Came not but make default &c
with force and armes &.c in and upon a Certain John Atkinson Townsend Jun.r in the peace of God and the Lord Proprietary then and there being an assault did make and him did beat wound and Evilly Entreat so that of his Life it was dispaired and other harms to him then and there did doe to his Great damage and Against the peace of the right honrble the Lord Porprietary his good rule and government whereof the Same Levin for ye said Lord prory prays advisement of ye Court &c L Gale P Dom Thereupon Command was Given to the sher of Somerset County that [illegible] Archibald Starling if &c to answer &c and afterwards in the Same Court Came the said Archibald Starling in his proper person and being by the Sher Sett to the Barr is thereupon Instantly demanded how he would acquit himselfe of the premisses afd says that of the premisses afd upon him Imposed he is guilty thereof and is willing to pay his fine for ye fact afd Therefore it is Considered by the Court here that the afd Archibald Sterling pay unto his said Lordship for his fine by the Court hereupon him Imposed for and by Occasion of the trespass & assault afd whereof in form afd he is Convict fifty pounds of tob.o and yt the said Archibald Sterling be taken to Satisfie ye fine afd ordered given security for fees Coll Gale sery for fees
