the within account is Just and true as it stands Stated and that he never did Receive any part or percell thereof or
any thing in satisfaction for it more than he hath given Creditt for therein and that it Cost him the sum of Six pounds
Ninteen shillings and Six pence Ster for Insuring a sloop of the within Nathaniel Horsey at his request

            And the afd Nathaniel Horsey by Francis Allen his attorney Comes and defends the force and Injury when &c
and prays Leave to Imparle hereunto untill the next Court and he hath it and the Same day is given to the afd
Plft here also &.c
                            Att which said Next Court to witt the Ninteenth day of August One thousand Seven hundred and
twenty nine Came again as well the afd Richard Waters as the afd Nathaniel Horsey by their attorneys afd
and the same Nathaniel by his said attorney prays further Leave thereof to Imparle here^unto^ untill the next Court
and he hath it and the same day is Given to the afd Plft here also &c

             Att which said next Court to witt the Eighteenth day November anno Dom One thousand Seven hundred and
twenty Nine Came again as well the afd Richard Waters as the afd Nathaniel Horsey by their attorneys
and the afd Nathaniel Horsey by his said attorney prays further Leave ^thereof^ to Imparle hereunto untill the
next Court and he hath it and the Same day is Given to the afd Plft here also &c

                      Att which said next Court to witt the seventeenth day March anno Dom One thousand seven hundred
and twenty Nine Came againe as well the afd Richard Waters as the afd Nathaniel Horsey by their attorneys
afd and the afd Nathaniel Horsey by his said attorney prays further Leave thereof to Imparle hereunto
untill the Next Court and he hath it and the Same day is given the afd Plft here also &c

      Att which said next Court to witt the sixteenth day of June Anno Dom One thousand Seven hundred and
Twenty Nine Came again as well the afd Richard Waters as the afd Nathaniel Horsey by their attorneys afd and the
afd Nathaniel Horsey by his said attorney as before defends the force and Injury when &.c and Saith that he did not
assume upon himselfe in Manner and form as the said Richard above against him hath Complained and of this
he putts himselfe upon the Country &.c   and the Plft in like Manner

             Thereupon at the prayer of the Plft and Deft by their attorneys afd Command is Given to the sher of
Somerset County that he Cause to Come here Twelve ^the one hath thereof be Merchants^ &.c by whom &c who neither &.c to recognize &.c because as
well &c of which said Preceipt the said Sherr to witt John Purnall Gent Now here at the Same day and Year Last
mentioned Comes and makes Return that he hath here ready Twelve &.c as by his Said Preceipt he was Commanded
and now hereafterwards to witt the Same day and Year Came as well the afd Plft as the afd deft by their attorneys
afd and the Jurors of that Jury therein Impannelled being Called Came to witt John Tunstall, Patrick Lackey
Archibald Starling, John Donelson, John Stewart James Lindow, Edward Beachamp W.m McClammey John
Holland Johnson Hill David Hazard John Scarbrough   who being duely Elected tryed and Sworn to Say the
truth in the premises upon their Oath do Say that the afd Nathaniel Horsey did assume upon himselfe in Manner
and form as the afd Richard above against him hath Complained and do assess the damages of the Same Richard beyound
his Costs and Charges by him about his Suit in that part apposed to two pounds Seventeen shillings Currant Money and for
those Costs and Charges to One pound of tobacco &c

                         Therefore it is Considered that the afd Richard Waters Recover against the afd Nathaniel Horsey his
damages afd by the Jurors afd in form afd assessed to two pounds Seventeen shillings Curr money and One pound of
tobacco as also six hundred and three                                             pounds of tobacco for his Costs and Charges afd to the
603   Same Richard by the Court hereof his assent of Increase adjudged which Certain Damages in the whole do amount to
603   two pounds Seventeen shillings Curr.t money &c  Six hundred & Four                                      pounds of tobacco and
the afd deft in Mercy &c
