 Somerset County ss    Abraham Smith late of Somerset County planter was attached to answer
unto John Murray of a plea of trespass upon the Case &c
         And whereupon the said John by Francis Allen his attorney Complaines that whereas the
                                  said Abraham the first day of November anno Dom One thousand Seven hundred and twenty eight
at somerset County afd within the Jurisdiction of this Court was Indebted unto the Said John in fourteen pounds Seventeen
Shillings and five pence Currant Money of Maryland it being as well for sundry goods wears and Merchantdizes by
the Said John to the Said Abraham at the Especiall Instance and request of the Said Abraham before that time there
sold and delivered as for Sundry Sums of Money by the Said John for the Said Abraham before that time there deposited
and paid at the Like Speciall Instance and request of the Said Abraham as by account hereunto annexed may appear
and being so thereof Indebted the Said Abraham in Consideration thereof the day and Year afd at the place afd within the
Jurisdiction afd upon himselfe did assume and to the Said John then and there did faithfully promise that he the said
Abraham the said fourteen pounds seven shillings and five pence to the Said John when he should be afterwards thereunto requested
he would well and faithfully pay and Content and altho' the Said Abraham afterwards did Satisfie and pay unto the said
John seven pounds and three pence percell of the afd fourteen pounds Seven shillings and five pence yet to Seven pounds
Seven shillings and two pence Residue of the said Fourteen pounds Seven shillings and five pence the Said Abraham his
promise and assumption afd in form afd made nothing Regarding but Plotting and fraudulently Intending the Said John
in that part Craftilly and Subtilly to deceive and defraud the Said Seven pounds Seven Shillings and five pence to the
said John altho' the Same to do the same Abraham by the Same John the afd first day of November in the Year afd and often
afterwards at Somerset County afd within the Jurisdiction afd he was thereunto Requested hath not paid or to him for the Same
in any wise Contented but the Same to him hitherto to pay or in any Sort to Content hath altogether Refused and Still doth
Refuse and deny whereupon he Saith he is worse and hath damage to the value of fourteen pounds Money afd and thereupon
