in the County afd within the Jurisdiction of this Court one hat of the value of thirty pounds of tobacco one shirt of the value of sixty pounds of tobacco and one silk handkerchife of the value of twelve pounds of tobacco of the proper Goods and Chattles of a Certain Patrick Waters then and there being and found then and there feloniously did Steal take and Carry away against the form of the act of assembly of this province in such Case made and provided and against the peace of the right honrble the Lord Proprietary that Now is his good rule and Government &.c F Allen assigned P Cur to prosecute Test Patrick Waters Prose.r Capt John Scott Littleton Townsend On the Backside of the foregoeing bill of Indictment it was thus Endorsed viz.t we the Grand Inquest of Somersett County do find or Returne this Bill Ignoramus William Piper Foreman Att the prayer of Francis Allen Gent on behalfe of the afd James Garrett to be discharged out of Custody of the sher of Somersett County into whose Custody was Committed for the Cause afd the said James Garrett present herein Court is discharged from Custody as afd and ordered to give Security for the payment of the Severall Officers their fees due by Occasion of the premisses afd but for want thereof the Said James Garrett is Committed into the Custody of the Sherr of Somersett County there to remaine &c till the Severall Officers of their fees be fully satisfied &c Charles Buckworth appears according to his Recognizance Entered into before John Handy one of his Lordships Justices of the peace for the County afd for his appearance hereat this Court and good behaviour &c Whereupon Came hereinto Court here the afd Charles Buckworth in his proper person and prays that his appearance may be recorded to save himselfe and Securitys from a Certain Recognizance of Bail Entered into as afd &c Thereupon the afd Charles Buckworths appearance is Recorded and he and his securitys accordingly discharged &c whereupon the said Charles Buckworth is ordered to give Security for the Severall Officers their fees due by Occasion of the Premises afd Thereupon a Certain John Handy of Somersett County Gent.m present here in Court for the Said Charles Buckworth to pay the Severall Officers their fees due by Occasion of the premises afd &c David Ailwood appears according to his recognizance Entered into before John Handy of somerset County Gent and one of his Lordships Justices of the peace for the County afd for his good behaviour and appearance at this Court &c Whereupon Come hereinto Court the afd David Ailwood in his proper person and prays that his appearance may be recorded to save himselfe and Security from a Certain Recognizance of Bail Entered into as afd &c Thereupon the afd David Ailwoods appearance is recorded and he and his Securitys accordingly discharged &.c whereupon it is ordered by the Court here that the afd David Ailwood give Security for the Severall Officers their fees due by Occasion of the premisses afd Thereupon a Certain Aaron Lynn of somersett County present herein Court undertakes for the Said David Ailwood to pay the Severall Officers their fees due by Occasion of the premisses afd &c To Francis Allen one of the attorneys of Somersett County Court I do hereby Impower you as well to prosecute and defend all actions wherein I shall be Concerned in somersett County Court as wittness my hand and Seal this 17th day of June anno Dom 1730 Robert Smith (seal) Sealed and delivered in presence of Us Jno Handy |
