of this Court was Indebted unto the Same Joseph in the Sum of Ninteen hundred and Twenty six pounds of tobacco Ballance of an account herewithin Court produced and so thereof being Indebted the said Edward in Consideration thereof afterwards to witt the Same day and Year afd at the County afd and within the afd Jurisdiction upon himselfe assumed and to the Same Joseph then and there faithfully promised that he y.e said Edward when afterwards he should be thereunto requested he the afd Sum of Ninteen hundred and twenty six pounds of tobacco unto the same Joseph he would well and faithfully Content and pay nevertheless the afd Joseph his promise and assumption afd in form afd made Little regarding but plotting and fraudulently Intending him the said Joseph in that part Craftilly and Subtilly to defrand and deceive he the afd Sum of Ninteen hundred and Twenty Six pounds of tobacco nor any part thereof unto the Same Joseph hath not paid or him for it in any wise Contented altho' the said Edward the same to doe afterwards to witt the same day and Year afd at the County afd within the afd Jurisdiction was thereto requested but the said Edward the Same hitherto to doe hath altogether refused and still doth refuse whereby the same Joseph says he is worse and hath damage to the Value of three thousand pounds of tobo and thereof he brings this suit &c L Gale P Quer pledges &c Jno Doe R Roe
And the said Edward Rownd by George Dashiell his attorney Comes and defends the force and Injury when &.c and the same attorney says that he is Informed by the Same defendant his Clyant of any answer for the same deft to the afd Plft in the plea afd to be given and nothing else thereof says by which the Same plft remaineth against the afd deft thereof undefended For which ^the same^ Joseph his damages against the afd Edward by Occasion of the nonperformance of the promise and assumption afd Ought to Recover but because it is unknown to his Lordships Justices here what damages the Same Joseph in that part Sustained Therefore Command is given to the sherrife of Somersett County that by the Oath of honest and lawfull men of his bailywick or County he diligently Enquire what damages the Same Joseph hath Sustained as well by Occasion of the Non performance of the promise and assumption afd as for his Costs and Charges by him about his suit in that part apposed and the Inquisition which thereupon he shall take to the Justices of his Lordships County Court of Somerseett to be held at dividing Creek the third tuesday of June next under his seal and the Seales of them by whose Oath he take y.e same Inquisition he send together with his said Lordships writt to him thereof directed and the same day is Given to the afd Joseph Here also &.c Att which said third tuesday of June to witt the Sixteenth day of the (same) |
